In my opinion, a company in Kolkata (PCCare247) has committed internet fraud and has cost me $1200.00. I have reason to believe they have committed a crime.
In January 2012, I purchased an advanced anti-virus program from Avast. I was already a customer of Avast - I bought an anti-virus after a year’s free trial of the program. Avast made the offer to sell me a newer version of the anti-virus program when I initiated action to begin a scan of my computer for viruses. The agreement I made with Avast was that I could install the anti-virus program on three of my computers. I installed the program in January 2012 on what my wife and I consider being “my computer.” My intention was to install the other copies at a later date on: 1. My wife’s computer and 2. My laptop computer.
On Sunday evening, the 26th of February, 2012, I decided to install the Avast anti-virus program on my wife’s computer. I went to the internet through Internet Explorer and typed in Avast in the search bar, not through the URL (I think that is what it is called; it’s the place where one can enter a website via http://www.something.com, for example). The first choice provided by Internet Explorer was Avast.
I clicked on the first entry (first choice in the list). In response I was asked for my telephone number. In a few moments I received a call from someone who identified himself as an Avast representative. I told him I wanted to install the anti-virus program in my second computer. The Avast person told me Avast had made arrangements (maybe contracted, I’m not sure) with PCCare247 and it would be necessary for me to leave the Avast website and enter the PCCare247 website. I agreed - assuming I would get instructions to install the Anti-virus program. The Avast or PCCare247 person told me I would have to enter a code in a space that appeared on my computer screen (it was five or six digit number). I complied. The Avast or PCCare247 person took control of my computer and told me not to use the mouse; he would take care of everything. He said he would do a brief search of my computer to determine if I had any viruses or malware. As I watched he went to the task manager or register (at least something that looked like what I had seen from time to time). He zipped the cursor up and down the list of programs; he suddenly stopped at one and said there is the problem. After a moment the entire screen was filled with lines of strange symbols and names. He started exclaiming, “Oh my God, Oh my God, Oh my God. I have never seen a computer filled with so many viruses.” He repeated this. He asked if I conducted online banking. I said yes. Then he went into a long spiel about how my bank account and pin number were surely to be stolen any minute along with numerous other problems, including stolen identity. All were in immediate danger. I had to act fast. So, he said he could clean up my computer and eliminate all of these risks for only four hundred dollars ($400.00). He explained again that I was in immediate danger. Then we talked about the other two computers and he said since they were linked with a wireless apparatus my computer tech had set up for me, then all three were in the same serious situation. He said it would do no good to clean up just one, because the other two would corrupt it again. So, I agreed to have the other two cleaned. When I complained that a fee of $400 for the third computer was unfair and that I was beginning to lose my respect for Avast for the whole thing. He said he would get his supervisor. She talked with me for a few minutes and said she would give me a break and charge only $200.00 for the third computer. When I received confirmation via my email I was charged $400.00 times three for a total of $1200.00 My American Express Bill showed I owed $1200.00.
I know I was slow catching on to the fact that this person may not be from Avast. When I saw the $1200.00 charge, it was confirmed in my mind that someone had posed as an Avast representative and had taken $1200.00 from me under false pretenses.
I went to the AMEX website to “my account” and entered a request for investigation for the three charges (400.00 each). I received correspondence from AMEX on March 6 that they would investigate and let me know something. They also said for me to not pay the $1200.00 – I assume until the investigation is complete.
Someone from PCCare247 called on Friday (March 3rd, 2012), I was not home.[actually it was Monday, the 5th at 606pm]. I received an email on Sunday, March 4th, 2012, asking me to call Jesher Mohan Lal at 1-855-877-5849 or I could email. I emailed and said I would be home on Tuesday and Wednesday (March 5 and 6, 2012). No Call. So, I called 1-855-877-5849 at 125PM (March 7, 2012). The person who answered the phone said I had reached PCCare247, but Mr. Jesher Mohan Lal was not available. But in the future please refer to my case number 90936.

I emailed the following to stop payment to PayCommerce (email failed) and PCCare247:
Dear PayCommerce and PCCare247,
I rescind the following orders. I cancel them. Do not take money from my AMEX account
Under the law, the salesperson must tell you about your cancellation rights at the time of sale. The salesperson also must give you two copies of a cancellation form, one to keep and one to send, and a copy of your contract or receipt. The contract or receipt should be dated, show the name and address of the seller, and explain your right to cancel.
If the salesperson provided you with the right forms, to cancel the sale you may simply sign the one titled "notice of cancellation," date it, and mail it back to the seller. To obtain a full refund, you must do this before midnight of the third business day after the sale. Keep a copy of the form.
If the salesperson did not provide a cancellation form, you may still cancel your contract. Because the seller violated the law by not providing the form, you have extra time. But remember, you must cancel in writing. Be sure to keep a copy of the contract and your letter notifying the seller of the cancellation. It is a good idea to get this done as soon as possible.
