Sequence Of Events
After seeing their ad on tv I went onto the Wowcher.co.uk website to see their deals and saw a watch and ordered it, payed the p&p to merchant and waited. Then no watch arrived even though it was placed on 31st August 2012 not received so I chased it up, below email correspondence.

* I placed the above order on 31st August and received an email on 12th September to advise it had been shipped but I still haven't received the order and on your site I am unable to track it.
Could you look into this and inform me when I expect to receive this item. * Your order was shipped on 12-09-2012. * Thank you for the email, do you have tracking information as I still haven't received it.* Kindly check with your local postoffice and we will do our utmost best to trace it for you.* In order to check in the post office I require the tracking number and also the mode of postage (Recorded Delivery, Special Delivery, Courier), these should be readily available as this is your proof of postage. *Email to Wowcher: I used the above voucher for the Watch and paid the postage fee however still haven't received my item. I emailed the merchant requesting info and they replied that the order had been shipped 12th September 2012, I then requested any tracking info but no reply. On their website there is only a mobile number and that doesn't allow me to talk to anyone.*Reply from Wowcher: Please would you be able to address the issue(s) below with the customer (and ourselves) as a matter of urgency?
We hope to hear from you within 72 hours - your help in these matters is greatly appreciated. And thats it 10 emails later and still at the same position I was over 6 weeks ago and the merchant even replied saying that they wouldn't issue refund as the item was posted ages ago, well unless the magic fairies have got it I don't think I'll see the time of day. I beleive Wowcher are unable to satisfy their contractual obligations and therefore, I am requesting a refund of all monies paid as well as compensation and I believe that them retaining monies when they cannot provide the service as agreed - amounts to an unfair contract term.
