I ordered 2 pair of women's Dansko shoes & eventually received a small pest strip from China. Pay Pay closed the case because the seller claims to have shipped to my address. I have reopened the case and am trying to explain the fraud.

  • I sent this to PayPal and I got a full refund of $266. It is worth a try!

    In response to an equitable argument, Paypal resorts to the technicalities present in the User Agreement. Paypal was or should have been on notice that this merchant was engaged in widespread, fraudulent behavior that extends beyond this one transaction. It is apparent from the Paypal response that they have the knowledge and resources to access this bad actor and remedy what is a pattern of possibly criminal activity. Paypal should not be able to escape its due diligence and monitoring obligations. This is not a singular instance and they are in the best position to right this wrong rather than to benefit from it. To the extent that Paypal was on notice actually or constructively in enabling this merchant to continue its fraudulent activity under the respectable color of Paypal’s umbrella, Paypal could well be answerable in other forums including to the United States Postal Service through which these transactions were “completed”. In denying the claim Paypal has abused its discretion and breached its obligation of good faith. Paypal acknowledges that “PayPal does monitor buyer complaints and seller’s activity and does take appropriate action against sellers when necessary”. We request that Paypal take the equitable and appropriate action and arrange a refund.
