On March 11, 2011 I made application via Efinancial (representative of Fidelity Life Assoc.) over the telephone. I talked at length to the agent about possibly obtaining life insurance for myself. He filled in an application over the phone with the information I gave him. He told me he would try and find and insurance company that would offer me insurance. Once he found a company that was willing to offer me insurance, I could decide whether I wanted to accept their offer or not. He told me he needed my credit card number to complete the application. I told him I didn't feel comfortable in giving it to him but he insisted that he have it in order to complete the application process that he could not submit the application for an offer without it. I told him I did not want anything charged to it and he assured me it was part of the application process. When he contacted me with an "offer for insurance from Fidelity Life Assoc." On March 11, 2011, to look it over and discuss it with my children and sign the acceptance. After reviewing it, I decided to decline their offer on March 22, 2011 via email. On March 24, 2100 the agent emailed me begging me to reconsider declining the initial offer from FLA. On March 24, 2011 I again declined the offer from FLA via email saying this is not the policy I am interested in but thank you. This made two times I had declined their "initial offer" for insurance via email. I thought this was the end....wrong.On May 2, 2011 I received my credit card statement and low and behold, there is a charge for $178.57, the first month premium for a policy that went into effect on March 25, 2011....Now remind you, I had declined their "offer" for insurance once on March 22nd and then again on March 24th before the so called policy went into effect on the 25th. I called them and they said they never received a cancellation notice from me in writing cancelling this policy. I said what policy, I didn't accept your offer. They said since they didn't get anything back saying I didn't want it, they went ahead and issued a policy and charged by credit card. How funny, they got all my info on my application and my credit card number but they never got by two requests to decline their offer! Hmmmm! Was someone's commission as risk here! I immediately faxed them a note saying this policy should never have been written as I never authorized it or the payment for it. Well, here comes my next month credit card statement and much to my disbelief there is another charge for another month's premium of $178.57. After numerous pieces of correspondence between myself and my credit card company, they have twice issued me a credit for these charges and have twice recharged me because FLA believes they are entitled to these premiums. I don't know how much clearer I can make it, "I declined there offer not once, but two times before the effect date of the so called policy in writing via email and having it recognized by their agent who tried to talk me out of it. I didn't want their insurance, it wasn't what I wanted and I declined it. Yet, they still went ahead without my authorization and charged two months premium to my credit card. This is an on going battle where we both believe we are right. Any help and/or insight into bringing this nightmare to an end would be greatly appreciated. Thank you, Joanna Nearpass
