May 2nd I ordered the $1.00 sample that includes an $8.96 shipping fee, on May 3rd that amount was debited from my bank account. I was OK with that transaction. I went out of town May 20th, returning home on May 27th. There was a post card in my mail box, that stated the post office had tried to deliver a package on May 22nd and that it would be returned to sender if not picked up by May 26th.(I guess that was my lifesaver) I didn't receive any other packages or notifications from Mineral Elements by Eden, and no Email either.
Then on June 13th I got the whammy.Mineral Elements by Eden had charged my bank account $127.37. when I called the bank they said I had to wait at least 4 days to find out who had debited my account. So I waited there was nothing else I could do.
Monday morning June 18th I called Mineral Elements by Eden Customer Service:
1 866 283 7313 . I was on hold for about 25 minutes, with that recorded statement that my conversation would be recorded. When someone came on the line finally I asked them to please repeat their name because I was informing her that I was Recording our conversation for my records.( I know intimidation tactics)
I told her what had happened and I wanted my money returned to my account. She went on to tell me that policy states that I still had to pay for the returned items. I then told her that the post office told me that this is the law. Domestic Mail Manual (DMM), Sect. 604.8.1.2 and Sect. 507.1.8.2 provide two instances where mail can be refused when it is offered for delivery, or, after delivery, you may mark “Refused” and return it unopened within a reasonable time. and at that time the sender pays for the return shipping. She then got all blustery and stated I still had to pay for shipping. I told her that I did not receive anything so I was not paying for anything and I repeated to her that the Postmaster said it was the law and I did not have to pay anything the Sender has to pay for all shipping. I think by then I had her flustered, she asked if she could put me on hold for a minute. I said OK. When she got back on the phone, she had a changed attitude, she was all nice, telling me my account was canceled and that within the next 10 days all of my money would be returned to my account. The charge on May3rd $8.96 and the charge on June 13th $127.37. It would all be refunded minus $1.00 by June 28th. She gave me a confirmation number I asked her to repeat her name, and I said good bye.
I guess reminding the company about Postal Laws helped. At first she was telling me what I needed to do and what they wouldn't do. Until I mentioned US postal laws. I hope that this will help some one else who has been scammed by this BS company
