Complaint Description:
I found fastcolorprinter.com -( Fast Color Printer, Inc. 2390 26th Ave N St. Petersburg, FL 33713) in an online search seeking two sided color postcard printing. I submitted payment in consideration 4 separate printing jobs On May 20 2011, using a Chase Visa card. Not familiar with the fastcolorprinter.com checkout, I made the purchases ungrouped and before seeing what were described as "free artwork check" for each item. In other words; free digital proofing of resolution, color mode, safe area bleeds and the design itself. Described as: "This service is absolutely FREE and you are under no obligation or order or buy anything from us." I submitted the files as A, B, C, and D. Paid $371 (including s&h) x3 for 5000 6x9" 2 sided color postcards and $340 (including s&h) for 10000 4x6" 2 sided color postcards, for a total of $1453. I approved of A and D, A, being one of the 6x9" 2 sided color postcards and D, being the 2 sided 6x4" color postcard. I did not approve of B, or C, though I had paid $371 each or $742 on the possibility I would approve.

In initial email correspondence and phone conversations I was asked to wait and see the quality of the first two approved purchases being shipped to me before making the decision to reverse funds for the two unapproved postcards.

I was told getting my money back would take 10 days. Subsequently I was told a penalty of $50 per unapproved art check order would be subtracted from each of the 2 $371 unapproved purchases. That this would be held as a credit towards my next purchase. I argued the policy seemed to be intended for post "free" art check approval cancellation request and that I had not approved either B, or C. Fastcolorprinter.com terms of service:

"Cancellations
Cancelled orders require compensation for incurred costs and related obligations at the time of cancellation. Due to the speed of our turnaround, you may only cancel a job the same business day you place your order. A minimum charge of $35 is applied to jobs cancelled before our evening cutoff time of 6pm. A minimum charge of $50 is applied to jobs cancelled before plating occurs at 8pm. No refunds will be given for orders cancelled after 8pm of the same business day the order was placed."

Given purchases orders are made after an art check is approved, as was explained to me after I mistakenly prepaid, by a sales rep, I felt I was unfairly being penalized for paying before the "free art check". Terms in the cancellation policy such as "incurred costs and related obligations" "due to the speed of turnaround" "jobs cancelled before plating occurs at 8pm" all refer to a post "free art check" purchase approval. I had not approved, my artwork was not introduced to the cue, no incurred costs were imposed on fastcolorprinter.com. Their cancellation policy clearly related to orders payed for and placed post artwork approval. They countered with a $35 per order, or $70 refund penalty, I again asserted this was not a cancellation. the two proofs had not been approved in what was described as a "free atrwork check". Again they offered to hold my money and to credit me towards a future purchase. By this time they had lost me as a customer. I would not have my money held hostage to encourage my patronage. I was told the refund would take 10 days. It's been 2 months.

I filed a case with my bank, they erroneously framed the claim as a duplicate charge and the claim was denied, I've since refilled and the money has been credited by my bank to my account. I have no confidence fastcolorprinter.com will ever refund my money or give my bank accurate information. Fastcolorprinter.com is actively and willfully attempting to defraud me of $742. Fastcolorprinter.com refuses to answer emails regarding the refund.

I enjoyed assisting you and definitely would want to see you as a returning customer. Going forward, we can refund you and deduct $70 total, or we can use it as a full credit on your next order. Please let me know your decision.

I was not asked: "That's why I asked that you wait to view proofs first prior to placing the orders." I was told over the phone that I had mistakenly prepaid after I had done so before viewing the proofs. Mistake indeed.

Someone at fastcolorprinter.com, a manager, didn't like my interpretation of their cancellation policy: charging a customer with $50, or even $35 penalties for an unapproved art check order is predatory and an abuse of a return policy described in post artwork check terms. They then took the sophomoric position that I should lose all money, $742 for two unapproved, unprinted, unsent orders. Shame on fastcolorprinter.com. No integrity. Poisonous snakes in an industry that has served me well for 25 years.

    The Fastcolorprinter.com crooks responded with a contorted interpretation of their cancellation policy.

    To whom it may concern,


    Because my bank first erroneously framed the chargeback as a duplicate charge, then, in a second challenge, claimed not to have received a dozen pages faxed in support of the claim, my bank has offered to reopen the case.

    Fastcolorprinter.com "Free Artwork Check" clearly states:

    "Once we've done that, we'll email you back with a proof, or with instructions on how to make any corrections if he can't make them himself for you.
    This service is absolutely FREE and you are under no obligation or order or buy anything from us. If you have any questions about designing your art, or would like us to do it for you, please put that in the comments box above (you don't even need to upload anything) or call us toll-free at 888-828-5628"

    4 credit card transaction made on 20 May 2011 pending "Free Artwork Check"
    2 approved "Free Artwork Checks": A and D
    2 "no obligation" "Free Artwork Checks" not approved:

    B disapproved on 20 May 2011 2:45pm.

    C disapproved on 20 May 2011 2:47pm.

    Not given "ok to print" therefore fastcolorprinter.com did not "move these into production!" as Fastcolorprinter.com stated in solicitation of proof: "Please make sure all content is correct. If you approve, all we need is your "ok to print" and order to move these into production"

    Fastcolorprinter.com did not get approval on artwork checks B and C, as clearly stated above, did not get an "ok to print" "and..." therefore no "...order to move these into production"

    Fastcolorprinter.com, in their response, makes the unsubstantiated claim: "On Monday May 23rd, Mr. O called and informed us that he wanted to cancel the other two orders he had pending."

    "pending" legally defined as: Begun, but not yet completed; during; before the conclusion of; prior to the completion of; unsettled; in the process of adjustment.

    Pending "Free Artwork Check", an order has not been established. Artwork check states: "This service is absolutely FREE and you are under no obligation or order or buy anything from us."

    Fastcolorprinter.com order confirmation for files B and C falsely and in contradiction to uncontested fact of non approval of B and C states "Files: Already Checked":

    Order confirmation falsely describes files as "Already Checked". Credit card transaction occurred prior to Files being checked and approved.

    Fastcolorprinter.com goes on to state in their response:

    "As we can see through the meticulous separation of orders by Mr. O that the orders he places were, in fact, individual orders and not multiple charges in error by our establishment as he claimed. Each order was placed individually by him on his computer as seen by the i.p. address indicated on each order and he labeled each order as "A" "B" "C" and "D" in the special art intructions. Additionally, for each order to process, he agreed to the terms and conditions. We printed and shipped the orders that he approved and did not ship the orders that he disapproved. We proofed the art that he sent for the all of the orders and since we had done the graphics portion and he was canceling the orders after the close of business day on the day the orders were placed, we are standing by the cancellation policy in our terms and conditions stating "No refunds will be given for orders cancelled after 8pm of the same business day the order was placed."

    I do not contest making individual orders pending the "no obligation" "Free Artwork Check" Rather I contest the bait and switch regarding the promised "Free Artwork Check" I demand just recompense in the form of the refund promised in the following emails; the first email mistakenly refers to me as "Olaf" the second makes the correction:

    Furthermore Fastcolorprinter.com claims:
    "We proofed the art that he sent for the all of the orders and since we had done the graphics portion and he was canceling the orders after the close of business day on the day the orders were placed.."

    The "graphics portion" Fastcolorprinter.com claims they "had done" was in fact an unapproved "no obligation" "Free Artwork Check" Fastcolorprinter.com omits from their record, that they gave me the option of a refund or a credit. I chose the refund. Proof B and C "Free Artwork Checks" were rejected and therefore were never ordered. The credit card transactions were made on May 20th 2011, the "Free Artwork Check" was disapproved and sale cancelled before the end of the business day May 20th 2011.

    C disapproved on 20 May 2011 2:47pm.

    As a small business owner, artist, of limited means, father of a 4 1/2 year old son, 8 month old daughter, I can say Fastcolorprinter.com's not honoring it's "no obligation... Free Artwork Check" has been personally devastating. In spite of false claims of a "Free Artwork Check" and a promised refund; "Going forward, we can refund you and deduct $70 total" Fastcolorprinter.com has wrongfully withheld $742 for over 2 months. If my bank fails to address this, I'm left with an overdrawn account and no other recourse than to take fastcolorprinter.com to small claims court (1350 miles from where I live)

    After spending $600 for services rendered I never imagined the uncommitted $742 would be held in spite of the clear "no obligation, Free Artwork Check" claim on their site. Fastcolorprinter.com's terms and conditions regarding cancellation clearly refer to post proof "Free Artwork Check" approval. Fastcolorprinter.com's "no obligation, Free Artwork Check" gave me confidence my money would be safe pending the "Free Artwork Check". Fastcolorprinter.com is heartless, dishonest, and predatory in every regard. This case is far from closed.
