APPELATE COURT OVERTURNS DEFAULT JUDGEMENT AGAINST
FOUNDER OF WECOSIGN

November 25th 2015 Santa Ana, California The California appellate court overturned a default judgment by a unanimous vote against an orange county entrepreneur. Frank Jakubaitis, who was once responsible for the co-creation of the first “e book reader” in 1997, and then introduced the down-loadable “99 cent music card back in 1989. He then went on to develop a “wake boarding tower speaker” in 2005 and finally created WECOSIGN in 2009.

The judgment against Jakubaitis stemmed from litigation over the firing of (a former employee) Carlos Padilla III for pathological lying among other things. After Padilla was terminated, he sought out an attorney, Arash Shirdel to file suit against the company with 39 causes of actions.

The court motions, (largely frivolous and playing a game of gotcha) filed by Shirdel moved back and forth for three years. This type of legal activity can burn-up even the largest of cash reserves, says Jakubaitis, especially when the plaintiffs side is a contingent fee arrangement, and your defense is cost plus. The court file’s as authored by Shirdel read as if “Bag Dag Bob” was the author, says Jakubaitis. The writings are full of optimism, but are not even close to real events. However, they were rubber stamped by a Superior Court Judge without a trial, without a prove- up hearing, and without due process. This would be our one opening to the California Appellate Court, because among other violations we did know that Shirdel and Padilla manipulated the documents to get their judgment.

Fortunately, the opinion of three appellate judges made it very clear that this case needed to be “reversed as a matter of law” and they did so. However, sadly all the damage had been done to the Jakubaitis family and their Internet reputation.

Jakubaitis, led the company as CEO of WECOSIGN from a privately held company to a public company in a one years’ time, with an opening stock price of .35 cents a share on the OTCC market as he promised his shareholders he would do. The company enjoyed a flawless 4 year impeccable Internet reputation under his direction, and the company’s revenue increased year after year. He says he feels vindicated by the opinion of the appellate court but adds “Padilla destroyed a great company motivated by his lies and fed by his “greed” “But most of all, Padilla and his lawyer Shirdel” hurt the very investors that Padilla brought to the table, and now Shirdel and Padilla desperately need an escape goat.
