Last year January 1, 2013 received an notice from the US Department of Treasury that ECMC had requested a federal offset against me. I was given 60 days to challenge the offset with ECMC. ECMC never contacted me about the alleged debt. My federal retirement was garnished and my tax refund was seized. I did timely request a Review Hearing with the Department of Education and submitted a Financial Hardship with ECMC. I also filed a complaint with the Better Business Bureau. Dave Barrett Default Specialist with ECMC assured me he forwarded my request for a hearing with the Department of Education. I also contacted the Inspector General of the Department of Education. I attempted to make payment arrangements with GC Services they informed me that they were ordered to cease and desist all collection activity by ECMC. In or about June 14, 2013 ECMC refunded all monies they seized. Meanwhile I am still waiting for a hearing with the Department of Education. In October 2013 ECMC contacted me again about the samd alleged debt, I informed them that I was to waiting to be heard fully and completely before the Department of Education. The ECMC Rep stated they did not show that I ever requested a review hearing. Sometime in December 2013 ECMC resumed the federal offset without informing me. On January 1, 2014 my disability retirement was garnished. I was forced to make another request for a review hearing in January 2014. ECMC is suppose to cease and desist all collection activity once notice of the debtors request for a hearing. ECMC farmed my account to a third party debt collector. On January 16, 2014 I received a letter from ACT[Account Control Technology Inc]. ACT's letter gave me 30 days to validate the date. Duh ECMC requested a federal offset back in Dec 2013 and the garnishment commenced on Jan 1, 2014. So what is the point in giving me 30 days to validate the debt. ECMC & ACT refuses to cease and desist with all collection activity even though I have timely requested a Review Hearing with the Department of Education. I am challenging the debt I should not be bullied into paying on a debt I am not legally liable for. Shame on the Department of Education for hiring ECMC as debt collectors.
