I submitted a claim for $121.50 because UPS broke an electronic item in transit that I sold on EBAY for $65.00 plus $25.00 Shipping. That totals $90.00 and the shipping was $31.50 so I lost $121.50 because I had to refund my EBAY purchaser their entire $90.00 and I paid UPS the shipping charges for this shipment ($31.50) for a total of $121.50 that I either lost in the sale, or paid out of pocket.

The easy math is as follows: I sold the item for $90.00 on EBay that included $65.00 for the item and $25.00 shipping and was paid via Paypal. The buyer reversed her payment through her credit card company because the item arrived in a non-usable condition. Therefore my PayPal account for this transaction, is EXACTLY $0 (zero dollars), however, I paid UPS $31.50 to deliver the item safely and they did not do so.

UPS says they are only responsible for the value of the merchandise in the shipment and my opinion is that for my purposes, that value was/is $90.00 and, they owe me the refund of the lousy, negligent shipping job. Since they shorted me $25.00 that I charged for Shipping (and totally refunded to my purchaser due to UPS’s negligence), I am out $25.00.

Why should I suffer a loss due to UPS negligence? I am not unjustly enriched by the $25.00 I charged for shipping and in fact if the sale had completed with a good delivery, I would have paid $6.50 more than I charged for the shipping in the first place. Hardly an undue profit on my part.

Now that the sale did not complete, I not only made no profit at all, I lost, out of pocket, $25.00.

Where is the JUSTICE in that?
