I made a purchase from the Children’s Wear Shoppe on the 8/10/2012. It was agreed via email that the cost of 1000 pieces of mixed brands of clothing from new born to size 8 would cost $4500US with free shipping to Australia.
Upon receipt of the two boxes on Monday the 22/10/2012 I sorted and itemised them on a spread sheet. I did a final count of the items and it appeared to have 412 pieces of clothing missing. I immediately contacted Hiliary via email (as it states to do so in her terms and conditions)(dated the 22/10/2012) advising her that this was the case. I also explained in my email that some of the items sent were over the size requirement I specified in my email prior to purchase. In my email I specifically asked for a mixed lot of brands advertised in her email this includes brands such as Carters, Crazy 8, Old Navy, Gap and Disney however, I only received Gymboree, Crazy 8 and The Children’s Place. The Gymboree clothing Hiliary sent, does not suit my requirements. For a majority of the clothing there was only one style in one size. This is useless to my company as I require a number of the same size in the same style in different sizes. It also states in Hiliary’s email that she does not supply accessories however I received 4 summer hats.
I attempted to call Hiliary to discuss the issues with my delivery but Hiliary did not answer. I then sent a follow up email on the 24/10/2012 stressing that I felt that it was not my order for the above listed reasons.
With repeated attempts to call and email Hiliary to resolve this issue I finally reached her. She advised that she will send me replacements for the items that were too big but will investigate what happened to the missing items. After constant emails to Hiliary requesting the tracking number I only received it on the 14/11/2012. I received the package sent by Hiliary on the 23/11/2012. This clothing delivered was incorrect. There were items missing and dirty also a brand that was not listed in her previous email prior to my payment of the clothes.
Hiliary advised via email that she had well documented the clothing that was sent to me and adamant she is not at fault. However I have requested this information on many occasions so I can verify what she had sent against what was received.
As I feel this matter has not been resolved in a fair manner I contacted the Australian Customs Authority to gain advice in this situation.
I was advised to weigh the total purchase I had received from the supplier and verify this against the total weight identified on the shipping invoice. If the purchase weighs the same as the amount documented on the invoice then this is a good indication and evidence to support your claim of the missing items.
With this advice on hand I weighed the purchase on two completely different weighing machines. The weight given reflects what was on the shipping invoice.
I advised Hiliary of this information I received from Customs. I scanned and sent Hiliary a copy on the invoice Hiliary had signed declaring the weight of the order. Upon receipt of the second order she sent to replace the larger sizes the Invoice was hand written with very little information on it. This clearly indicates to me that she is knowingly committing a fraudulent offense.
All I am requesting is what I paid for. Nothing more nothing less. I have taken photos of all the clothing sent to me. I have evidence of the weight I received and an invoice with her declaration of the weight of the goods sent. I have all the email correspondence that was communicated between Hiliary and I.
