My complaint involves a two-year contract for gym membership for two adults (two new acquaintances as temporary roommates) billed for two to one member's bank debit card monthly despite other member's provision of requisite notice to the gym membership office of the total and permanent disabling injury sustained by the billed member within the first month of signing the two-year contract for two. The billing for both members to one member's debit card was only a temporary measure to assist the roommate. The two members' expectation that they had cancelled the contract comported with their actions of logging precisely zero visits each to the gym over the next two years and four months (which is beyond the contract's original end date), all during which time the two members continued to be billed as if still members on the contract. Furthermore, that billing continued for both members on the totally and permanently injured (former) member's debit card monthly either without any notice of each billing or with grossly inadequate notice of such. The gym staff and billing supervisor never once tried to contact either member to question the zero attendances by both members, despite fact Sport and Health's membership profiles prominently display zero attendance for two members. Therefore, the gym engaged in unauthorized monthly billing for two cancelled separate contractual memberships billed to one credit card at 63.00 month for two adults; worthy of mention, the debit card billing address on file at the gym was incorrect. The billing continued for two years and four months, even extending beyond the original date of end of contract. The auto-billing continued on the card despite a forthright, in-person provision of required notice for cancellation of full contract, in accordance with express provisions in the contract and Virginia law, due to near-death medical emergency of billed payer on the contract who remains on social security disability for a permanent and total disability to date. The billing was not noticed by the payer until he had the wherewithal to conduct his own financial matters. I want a full refund for both members as a matter of law and public policy.
