On Friday, September 29, 2012 I stopped by Finelines tattoo and scheduled a tattoo for Saturday, October 6th at noon. It was agreed that I would pay in full, $300 for this service. I wrote a check in the amount of $300 to the owner of Finelines tattoo. On Thursday, October 4th, I called Finelines tattoo and confirmed my appointment for noon on Saturday, October 7th.

Upon my travel to my appointment, at 11:25am, I received a phone call from the owner of Finelines tatto, Nichole Childs, informing me that she could not give me my tattoo due to illness. I explained to her that not only had I paid in full, I also called Thursday to confirm. I had also already left my house, and was headed to my appointment. She said that she could not meet me. I then demanded the return of my money for her failure to provide the promised services. At this point, she claimed that she "had already paid her rent, and could not refund". She also stated that she would like to reschedule. I informed her that I could not reschedule, the earliest time I would be able to would be December. I also stated that I had already arranged for this to be done today, and if she could not fulfill her obligation, I wanted my money back.

Nichole told me at that point she would need to call me back. At 11:37am, she did in fact call me back. Wherein, she stated that I could stop by Wednesday, October 10th, and collect my money. ($300) Upon arrival on Wednesday, October 10th, Nichole informed me that she would not refund my money. She claimed at that point that she has a no refund policy, and she could not be held responsible for becoming ill. I informed her that she was in fact the one that broke the agreement for services, and she specifically told me to stop by for my refund. At this point, she refused to return my $300 to me. She then told me to leave her store! I have the cancelled check. This is theft by any other definition. Now I must file civil charges in court in order to get my money back....This is Theft by deception!!!

  • Try a stop payment on your check if it has not cleared your bank. You might be able to do a resolution dispute through your bank as well. Report the company to your attorney general's office, the federal trade commission and consumer protection.
