In March 2012 I ordered a HTC phone on a £26 per month tarrif, which included 300 minutes, unlimited text and 500mb data and the cost of the phone was supposed to be £49.99.
Eventually, when I got the phone and the paper invoice it had £19.99 for the phone and I phoned Mobiles.co.uk at the time to inform them of this mistake. However,Kelly told me that the price of the phone had gone down since I placed the order and I accepted this over the phone. It should be noted that I was not informed of any other price or tarrif change at this time.and found out that I was being

After using my phone over the next few months and learning all the functions, I noticed the monthy charge on my bank statement looked high, so I investigated and noticed that I was being charged for my data usage.
Therefore, I went in to an O2 shop to enquire and I was informed that there was no data allowance on my £26 pm tarrif.

I then tried to complain to Mobiles.co.uk and a few times the internet site crashed and when I was chatting to customer services it cut my chat too. Eventually, I managed to contact customer services and one of the advisors informed me that there was no data allowance on my £26 pm tarrif and that it was an add on costing a further £6 pm.

However, this is not what I ordered and definetly not what I would have agreed to or authorised.
I mean no one in their right mind would order a smartphone and not have any data allowance on their tarrif.
I stopped using the data services since July on my mobile phone when I was on the move as, I did not want to incur additional charges.

This is causing me great inconvenience at present as I am unable to use my smartphone for internet access or email when not at home.

This is definetly not what I signed up for and when I phoned your customer services they were unable to provide me with the original order I placed with you.
They say I have to go to Carphone warehouse to get a copy, which to me is unacceptable as I did not place an order with Carphone warehouse, I placed the order with mobiles.co.uk.
Why should I be inconvenienced and go through all this hassle when all it will take is a phone call from you to your partner company (I assume this is what Carphone warehouse is to you) and you should be able to get some one to print it out and either fax it to you or email it to you.

I want to see my original order or a signed or agreed contract that I am supposed to have with you.

I can guess what has happened is that, I placed the order for £49.99 with a monthy £26 pm tarrif which included what I needed and either kelly or some one else in Mobiles.co.uk or CPW changed my order to £19.99 with £26 pm tarrif with a £6 bolt on totalling £32, which, I was never informed off and something which I never accepted.

I believe you are in breach of your contract with me as I distintively placed an order for £26 per month which, included 300 minutes, unlimited text and 500mb of data.
I have already complained to Ofcom and intend to complain to who ever and where ever possible including in the national papers unless you:

1. Re-instate the 500mb of data on my current tarrif without any additional charge.
2. Refund all charges of data usage charged on my account to date.
3. Compensate me for the inconvenience caused and for not being able to use my smartphone on the move, which is what they are supposed to be used for.

If you do not do the above within 14 days then, I will cancel my direct debit with you and cancel the contract and if necessary take legal proceedings or I am willing to go to court, hire a solicitor and present my case in front of a judge and see who wins and face the consequences.

I would also like to have confirmation of your decision within 14 days and you can contact me on my mobile (Personal Information Removed) to discuss this further and come to a mutual agreement.
