I had my car listed for sale privately on the internet. I was contacted by the above company offering to sell my car at their car yard on the condition I removed all my own advertising. The car was advertised on the web sites as poor condition, no log books and a totally different engine. All incorrect informatin. I was assured the vehicle would sell within 14 days and the cost was $395+gst. The cost after 14 days was listed as $11.14+gst per day When I withdrew the car 8 weeks later I was given an account for $998. When I complained about the advertising I was given a discount of $200. and had no option but pay to have the vehicle released.
I then contacted the car dealer and pointed out that I felt the car had not sold due to their advertising and raised doubts about what effort had been made to sell in to passing buyers.
I believe the car yard used my car to fill there car yard and never had any intentuion of selling it. It was making them $11.14 per day.
They refused to refund my money.

    In regards to your complaint, I would like to respond in saying that when you brought your vehicle to us you were fully aware that the vehicle was a repairable writeoff listed in NSW which you failed to advise us about, we found this information after doing a vehicle REV’s check and that you also had finance owing on the vehicle which there would be a shortfall amount on top of what the vehicle was worth.
    We tried to sell your motor vehicle and had a customer at a lower price than what you wanted to achieve. However understandably you did not accept the offer. National Car Connections advertised your vehicle on many sites, however the 1 you have indicated the complaint around must provide the condition of the vehicle, which means that we had to advise (by law) that the vehicle was a repairable write-off, thus meaning your vehicle is in poor condition.
    At the time you booked your vehicle in, you were completely aware of the costs involved and we did send you an email advising the websites after 3 days of the vehicle being with us. In this email, it asks you to check ALL websites and if there were any mistakes or problems, you were to contact us. However you did not comply to that and this has caused your upset with the 1 site. It was NOT something NCC is at fault for.
    There is no assurance or guarantee that a motor vehicle will sell and none of our consultants can promise a customer anything but the effort that will do our very best to sell a motor vehicle. When you advised that you were collecting the vehicle you did not mention any of these concerns to us.
    We gave you a discount from your fee’s out of good faith, we were not obliged to give you a discount as NCC had advertising, maintained, detailed, insured and had full security for your vehicle to which you were verbally advised about & even had that all in written documents.
