My husband was involved in a bad auto accident back in January of 2009. He was injured and unable to work for the rest of that year. During that time I was the sole provider for my family. My mortgage is financed through Beneficial. My interest on my loan is 11.93%. All of our bills became unbearable and out of control during this time. We added many bills as well during this time because of the accident we had to pay hospital bills, ambulance bills, doctor bills, physical therapy bills and many more. We are in debt up to our ears. I was contacted by Home Credit Law Center in January and they told me that my interest was out of control and that they could help me get my interest down to a 3% interest rating not only on my first mortgage but on my second mortgage as well. I went ahead and gave HCLC $3000.00 up front I filled out my paperwork part of which was the contract and refund policy. I went ahead signed the paperwork and sent my application in with wage information, credit information, bank statements, taxes and everything else that was requested. A forensic audit was done on my file with Beneficial and I received a letter that had been sent to Beneficial letting me know all of the things that were wrong with my loan I figured that my case was well on its way. I received an additional contract once my audit was done stating that the audit had been done and that they could still accept my case however the contract states that HCLC would have to exclude $995.00 from the amount guaranteed if a modification was not reached. At this point I am still thinking that even if it does not work out I would at least get $2000.00 of my money back. This is when things went bad. I started calling to try and find out what was going on with my case and I could not find out anything because my representative was either out of the office or on the other line ripping someone else off obviously. I was out of my mind for several weeks. I finally called one day and said that I would wait on the line until my representative was available. I was treated rude and I was disconneted several times. I continued to call back over and over and I was finally able to get someone that would listen to what I had to say. I let this person know about what I had been experiencing and that Don Williams was my representative and I had been having a difficult time getting in touch with him. The receptionist told me at that time my file had been turned over to the United Processing Center this happened in March. The receptionist gave me a phone number and I was able to speak with someone at that time. Basically what I was told was they were a processing center that takes my information and turns it over to the bank for possible modification. At that point and time I asked if they negotiated anything for me and I was repeatedly told that the decision is that of the bank. So basically I never really had any type of lawyer representation at all. As my said modification went on so did the months. I received notification from United Processing Center that my modification was denied and that it was not necessary to reapply because I would be denied again. I was told that someone from HCLC would be in touch with me as soon as possible to let me know where my case would go from there. I never heard anything from them. When I went into this process Don Williams told me to get on line and look up the lawyers license and to check with the BBB to see how they were rated. I did so and found no actions against the lawyer and the BBB rating was an A+ how could I go wrong. When I checked again the BBB rating had gone down to an F. There was a statement on line that the company was going to finish dealing with their current clients and would be going out of business. I also heard from people that I had been speaking with regarding my case that it was in the news in California that the company had gone bankrupt. I went ahead and did a certified letter requesting my money back and this is when the fireworks started. I went ahead and called Brian Linnekens directly regarding my refund and he told me that I did not get a refund because he had complied with his contract promises. My bank told United Processing Center that I could call Beneficial directly in a couple of months to see if they would defer my past due amount to the end of my loan. Mr Linnekens considered this a forberence agreement even though Beneficial told me directly that they had not reached any kind of agreement like that with anyone and that I could not get this type of agreement because my loan was not in foreclosure. Mr. Linnekins also told me that my application should be resubmitted again. I spoke in great detail with Beneficial and they let me know themselves that they do not do loan modifications at all. They will do a Hardship agreement for up to 5-6 months lowering your interest rate and payment however after the approved time the payment and interest go back to the original amount. I am only behind on my mortgage by a month and a half which is about $2000.00 therefore, I paid this great law firm $3000.00 to help me put $2000.00 to the end of my loan. I got screwed. I am out $3000.00 and I will end up paying interest on the amount that is put to the end of my loan. My line of credit went into default during this process so now I have to figure out how I will pay that amount of $20,000.00 as well as having to pay the money back that I borrowed to get HCLC's help. When I told Mr. Linnekens this he told me that they had gotten my paperwork ready to send to the bank and they had done the forensic audit and they deserved the money I had sent. I think it is important for people to know that Mr. Linnekens stated that there are several different people that deal with fools over the phone. The company that Don Williams worked for was a company that finds idiots over the phone collects their money and their part of it is over. Then your file goes over to the United Processing Center and they send your paperwork in. The lawyers do the forensic audit and never tell you that this can only be used if you go into litigation so in other words they did the audit so that later they could say that they had complied with the contract promises Mr. Linnekens says that they use the audit as leverage to get the modification. That is not true they do the audit so that they can keep your money. Stay away from these people total snakes in the grass they do not care about you or your problems. It is all about mumbo jumbo when they are talking. DO NOT EVER GIVE ANY MONEY UP FRONT TO THESE SCAMS.

  • There is never any guarantee with any loan mod work, you are paying for the application and review and their ATTEMPT to help you, not that they guarantee they can fix it. Unless of course it stated in their contract that they granted you a 100% guarantee, reread your contract.
