Dear Sirs:

I have an account with Acqua Grand Mazatlan reference a time share. Acqua Grand violated my contract and I canceled my payment after Acqua Grand discontinued communicating with me. I have sent them literally over a hundred e-mails. I have tried to call them, but always contact with someone who is not in charge and does not have the authority to fix the problem. I have been promised a dozen times to be called by a person in their legal/sales department. I have never received a call. After canceling my payment I of course started to receive calls from your company. First and foremost every person I have talked to from Universal Account Servicing LLC have been very Professional. The last person I talked to was Eugene Hale who told me that your company also had difficulties with contacting Acqua Grand. I did not find this surprising in the least bit. Since I started to have problems with Acqua Grand I have called everyone that does or should I say did do business with them when I signed up for the time share. I quickly found out that most have had the same problem I am experiencing and they have discontinued doing business with them. Even the company assigned to sell my old time share Premier Property Management told me that even if they did sell my old time share they did not have a way to finalize the sale as they could not contact Acqua Grand. Eugene Hale instructed me to call on 01-10-2012 if I have not received any contact with Acqua Grand. Since that instruction I have sent numerous e-mails and two (2) letters to Acqua Grand without a response. I am including a copy of both the letter and e-mail. Since I have not received a response from Acqua Grand I have called Eugene Hale ( I have left a message and am confident I will get a return call). Since Acqua Grand has violated my contact, refused to communicate with me after several attempts even after being contacted by your company, I consider my account closed and expect a full refund of all monies collected on behalf of Acqua Grand Mazatlan RIC.

At this time take notice that I am canceling my purchase with Acqua Grand as your company has violated the contact (#0167A). I have continued to try and contact you to rectify the problem but you continue to put me off. Even the times that I have had contact with your company the person I have talked to has always told me that they have no authority to rectify the problem. I was last contacted by your company on October 24th, 2011. I was told that I would receive another phone call on October 27th, 2011 at 8:30 A.M. your time. I stood by the phone for over four (4) hours and never received a call. I noted that you are under construction and are having problems with the phone lines. I cannot believe that a company of your stature does not employ one person that does not have a cell phone. I took time to contact Gold Crown Vacations to assist in correcting the problem. They informed me that they have stopped doing business with your company do to the same problems I am experiencing. I then contacted Trading Places asking for their assistance. They did inform me that they are still affiliated with Aqua Grand, but they do not have any more success with contacting you as I do. They also pointed out that it is not their place to assist me with my problem with your company, which I agree.
Since you have violated the contract and will not return my calls I have no other recourse then to cancel my purchase at Aqua Grand. I will be contacting Premier Property Management and revoking their authority to sell my property with Wyndham Resort Bonnet Creek. I expect a complete refund monies I have advanced in this purchase. The detailed list is listed below. The $11,770.00 that you received in advance for the sale of my property will remain with Acqua Grand “if” I receive a complete refund in the form a cashier’s check by no later than 01-15-2012. After 01-15-2012 I will be in contact with my attorney and will be seeking not only full reimbursement for all monies I paid in advance, but any and all monies that were taken in as the result of the attempted sale of my property. I need no further contact from anyone without the authority to rectify this problem.
List of expenditures I have already paid:
1. $2300.00 down payment placed on my credit card.
2. $550.00 enrollment fee placed on my credit card.
3. $137.62 monthly payment for the months of June, July, August, September and October of 2011 placed on my credit card. Total $688.10.
Total in reimbursement: $3538.10.
