International boundaries

I have purchased the following items on the 29/10/11:
1 x Apple® - iPad® 2 with Wi-Fi - 32GB - Black (G11) = £141.07
1 x Apple® - iPad® 2 with Wi-Fi - 16GB - Black (G10) = £105.80
Prior to ordering I have spoken to Linda via web365 who assured me that once I pay though Western Union they would ship the items within 24 hour. She even emailed me a list of tracking numbers for the parcels that they have recently sent to their customers which were safely delivered. I have transferred the money that evening and I received a pick up notification from Western Union the following morning.
48 hours later I still had no tracking number. I emailed them and here are the emails:

The tracking number is correct. We have contacted the carrier company again,they said that your item has been withheld by the Chinese Customs office and they need to levy duty £120.00. I'm sorry, but this does not sounds right. I have ordered a lot of items from china and never had to pay any levy duty. If that's the case then you can retreave the item from the customs and refund me the money please.

You can retrieve the package, I know that for a fact. You have to understand my point of view. You do not process payments through paypal, so there's no guarantee that I even receive my order. I am sure that I am not your only case who has to pay the levy duty as you have been doing the free shipping item for a while now. And according to you Recent orders section I am not
the only person who placed an order. I request as full refund as I begin to mistrust your company.

I have checked with the customs and I should only pay 20% of tax duty for the cost of the Ipad, and not 50% as you suggest. You are trying to scam me, so I am not happy to pay this! This is my first business with you and it already looks wrong! The last thing I want is to loose £247 pounds and another £120 and not even receive my order. I would not mind to pay 20% of duty customs, but only when I receive my order. I have already risked by transfering you the money through western union, not risking again until I receive the order!

I have check the duty rates and the rate on Ipads is 20%, you can see for yourself by going on this website http://www.dutycalculator.com/ it says that ''ipad2, ipad 2 is duty free and has a VAT rate of 20% ''. I will purchase some more products from your website, but only when I receive my first order. I cannot possibly order anymore if I haven't even received the first order yet. I do understand that you may not trust some of your customers, but you have to see it from my point of view, I need to see some sort of result before I can buy any more products. I agree to pay 20% of VAT rate, but only when I receive the order. I have ordered many items from China before and some of them were with free shipping and I never came across this problem. If you knew that this is the case you should have told your customers before taking the payment. This is how you should build you relationship with the customers and not misleading them!

I am sorry, but as I said I will only pay out the rest of the money on the day when I receive the package. The only reason I want to do it this way is to be on the safe side and to see whether you care about the customers and to prove that you are a genuine company. I already paid in total of £277.00 and still have not received my order. Originally when I spoke to you on through 365web you told me the package will be with me within 7 days and you never mentioned anything about the tax even though you knew that this problem will occur. I have trusted you and transferred the money even though there is no customer protection and now I believe its your turn to show your trust. As I said before you either make sure that I receive the package safely and then I pay the 20% tax or retrieve the package from the customs and give me full refund.

I really need to know what's is happening to my order. I appreciate the fact that you are going through some problems, but as a customer I need to know whats happening to my order or my money, therefore if I do not hear from you within the next 2 days I will have to take legal actions. It has been over 3 weeks since I have placed an order and paid you the money and yet I still got nothing. Hope we can settle this soon without extra problems.
