Michael O'Connor came into our apparel store, "Under The Banyan Tree" in Fenwick Island, DE and said he could do a mobile website for us. He did a very good job of selling us so we signed a contract and gave a deposit. After we didn't hear from him for a few days despite emails we called him and he said the site was done and that he would be in on Friday to show us. He came in on Friday to show us an uploaded business card to the web and demanded the rest of the contract balance. We never even talked to him about what we wanted the website to look like. When he started to get verbally aggressive with us, we asked him to leave. I then emailed his company to tell of the experience with no response. A few days later an email arrived stating we would get a refund in 10-15 business days. To date there has been no refund received. Subsequent emails for refund status have been unanswered and voicemails have not been returned. We are convinced this is a scam as there is no address on the contract. There is no address on the web site... and all the emails are public emails such as Yahoo.

  • WOW I didn't even know this was posted on here about me or
    our company until it was brought to my attention or I would have commented on
    this immediately this is actually comical and at the same time statements made
    about me in here are perfect grounds for a law suit based on slander and
    false assumptions if you want to know the truth read on.


    I am pasting the original complaint here first and going to answer each
    statement after to more easily understand my feedback, frustration and
    surprise. All my responses start with the words my response

    Michael O'Connor will approach your business with a uniform...The mobile Marketing experts embroidered shirt.

    My response: I was wearing a pair of nice dress slacks and a polo shirt
    with our company logo.

    Michael appears to be very professional and nice but a little sweaty.

    My response: This is comical you would be sweaty also if you were walking
    outside in the middle of summer in long dress pants.

    Michael was an Elvis performer and tells of his success with that and will show
    videos of him performing in Atlantic City.

    My response: I built an extremely strong reputation performing for a
    long time and even have 4-5 pages dedicated to my accomplishments and
    even had 15 full feature articles written about me and retired with my
    reputation completely intact.

    He ropes you in with these stories and then springs the Website and Mobile Website idea.

    My response: Never my intention to "Rope anyone in that statement
    is down rite insulting"
    I brought up my entertainment background to build re pore and for client to
    know I had nothing to hide not to be judged with a statement like roped in.

  • He shows you websites he purportedly did, which ultimately he didn't do.


    My response: This is what steps we do with each client to walk them thru
    the process and it’s no different here.
    1st we show a client our other clients original websites on a mobile
    phone that were probably created by another designer 2nd we then proceed
    by showing the client a mobile version of the clients website we did
    design. We even show the client a copy of the clients contract and or
    check with the routing information blacked out to prove we designed there
    mobile site ONLY that is exactly what was done here as well.

    It all looks good upfront. He doesn't take credit cards....red flag
    number one and he promises a website in a week.


    My response: Even though at the time we didn't accept credit cards we
    did accept company checks that were made payable to our company and a contract
    was signed.

    So, we bought into it and all he did was steal the website name...he registered
    as private and locked it so we don't have access to it AND just uploaded a
    business card and a few photos he took with his cell phone.

    My response: First we never stole anything as far as the domain name the
    client and I went over what domain name they wanted and we registered it but
    since we registered we did have the ability to either sell it to them or just
    release it but we never even got to that point. As far as hiding domain information that was entirely to secure website information from hackers and not the client. The 2nd accusation we took a few
    photos of their regular PC website we did design with a mobile phone only for
    the purpose of design approval. That was all we were just going over the
    initial design layout and not a finished website which we would have emailed
    them a link to view the full site on their own PC once completed.

    still not done I want to address each "FALSE ACCUSATION"

    again until after a week..He came into the store and aggressively requested the
    balance.


    My response: The statement above is completely false I asked the client
    what they wanted and both business owners constantly gave me different
    information it was clear they never went over anything together for a design
    idea so they responded back with your the expert we trust you and I explained
    we don't do regular web design so this will be a trial and error situation but
    if you bear with me we will do our best to make sure your happy. So after about
    a week or possibly 2 we met I showed them a few screen shots of the PC site we
    were working on just for design purposes only and not a finished site.

    We were in shock that this guy looked so professional, gave a good impression
    yet scammed us into a website that is basically a business card with 3
    blurry photos for $950.00. When I told him we weren't happy with the
    site, he proclaimed angrily that it would take more money to make it
    right.


    My response: The website design was more than a business card with 3
    blurry photos as far as design and when I met with the client 1st they knew we
    had a scheduled appointment time but they still made me wait almost an hour and
    I had to cancel another appointment with another client to accommodate their
    needs . Which was proof that Angela did not value my time at all as a person or
    our company they were rude snobbish and very arrogant towards me and the
    only reason I requested payment in full and more money was they also wanted
    some kind of online shopping set up which is not what we agreed on first so
    anyone who designs sites can tell you that it can get very costly. The money
    asked for was what our designers had charged us so far.

  • We promptly sent an email to the "corporate" office and got a
    snappy reply back with a promise of a refund that we have never
    received. Good businesses give refunds or attempt to make it right.
    This guy has made promises to make it right and refund the $ but comes
    up with every excuse under the sun why he hasn't done anything. TOTAL
    SCAM!!


    My response: We received the email but also told the client there are no
    refunds and told them that from the very beginning even before we signed the
    agreement anyone who designs websites will tell you that designers are usually
    paid up front just like cellular phone carrier you wouldn't call your cell
    carrier back and say OK you provided me with cell coverage for a week I want a
    refund it doesn't work like that. This was a clear case of a waste of our time
    and the client wanted everything for nothing we would have done everything to
    make them happy but they didn't care what we had to say and didn't even give us
    a chance to make it right.

    The bottom line the client did get a partial refund on an amount we agreed on
    and still after they got their refund decided to post this joke of a report on
    here anyway. They are the only and most frustrating unprofessional business
    owners we ever dealt with. And since dealing with them we have changed allot of
    our policy to avoid situations like this in the future. I will not justify this
    report by giving the business name on here but I will say this they think they
    are better than everyone else which is a complete shame

    And after seeing this report the client is extremely lucky we don't sue for slander which would most certainly win I have keep copies of every email and text message for reference.
    This whole posting from this client makes me totally ill such false statements.

  • This is my response to this whole negative experience We agreed on amount to give them back and we did take care of this and they have the nerve to file a false complaint anyway after everything you have read you be the judge I welcome all comments.
    We are soo tempted to soo for atleast $20-$25,000 in damages and the statement I was asked to leave the fact is I only wanted to make them happy with a design they would be happy with but they became extremely agitated and acted like I was something that they would wipe off of there shoe instead of coming up with a plan of action and I was completely shocked about their behavior and I just wanted to make it rite that's all.
