Our home was in foreclosure and we received a flyer from HSBC with Home Affordable Direct number stating they are a home save program. So we called the number. I spoke with John Anthony and we talked about how he can help us. We were told that they would hold the check until they are able to guarantee the loan to be modified. We signed a contract stating that if they cannot help nus save our home we could get a full refund on the money we paid them. It has been over two months since this process was started and we have not gotten anywhere. I spoke with HSBC and they stated that all they have received from Home Affordable Direct was the third party authorization. Our loan has since been sold to another lender. I would have thought since Home Affordable Direct was supposed to be working on our modification they would have know this before myself. As of November 1st we have not gotten anywhere in the effort to save our home. I received numerous calls about our home and once they cashed our check we have not received any phone calls. All calls that were made was on us. We called them, they did not call us. We asked constantly for updates and was told our paperwork was in review at HSBC. We asked them for a copy of the packet they sent to HSBC ans was told by Tina Marie that they cannot legally give us a copy. I then called and asked to speak with Javier Gutierrez (owner) who have not returned my phone call. It have been over a month since I made that call. I talked to John Anthony about our refund and he becomes loud and raises his voice not letting me speak. He begins to keep asking me if I want to save my home. Now he is telling me I have to file bankruptcy in order to stop the bank from foreclosing but not send in the paperwork to actually do the foreclosure. I filed a complaint with the Better Business Bureau. I received a reply from Tina Marie which had the documents they said they faxed to our mortgage company and I called the mortgage company to ask them if they had received the same documents. They stated they had not received them. This is a back and forth thing with Home Affordable Direct. I keep calling them asking for a refund and they keep telling me that I am under contract with them to help us and they are I just need to let them do their job. It has been over two months. I think I gave them enough time to do their job. I just want my refund they said I was to get if they couldn't help me. Now that I have a new mortgage company they said they spoke with them and that they will not do the modification unless I stop the foreclosure date. So they want me to file bankruptcy to stop the sale date and they said this is the only way. This company is a scam. They say they guarantee and will give you a refund. Why would they tell you they will give you your money back if they can guarantee.
