I recently gave a suit to Big Apple Laundries for dry cleaning, and they provided me with a receipt confirming that they received the suit. However, the suit was never returned with my other dry cleaning. When I spoke with the owner about this issue, he accepted responsibility for the loss, saying that it was his driver’s fault. Either the driver stole the suit himself, or he delivered it to the wrong customer. However, either way, the owner conceded it was the business’ responsibility.

However, the owner has refused to provide me with any damages related to the loss of the suit, which I recently purchased for ~$1,000.00. He initially offered me $100 for the suit, and then $300 in cash plus $200 in future laundry services. However, he rescinded those offers within 5 minutes of making them. He said he was now offering me nothing, because my roommate answered the door when the driver made the delivery—not me. The owner claims that my roommate, in answering the door and allowing the drop-off to be made, accepted the dry cleaning in the condition that it arrived. Therefore, the owner asserts that he has no further liability in the case, and the suit that was never delivered is my roommate’s fault.

The only reason my roommate answered the door was because I was out of town. And, I was out of town for the delivery because the dry cleaner had missed the two delivery times I had previously scheduled with them. Because of these two missed deliveries, the dry cleaner now claims no financial responsibility for the missing suit—an outrageous assertion.

Update: 05/03/2013

The issue has been resolved. Big Apple Laundries found my suit, and there is no further issue. The owner has said that he will be more clear with his customers in the future about his liability for lost items.
