Tried to refinance in 2009 with a FHA from Wells Fargo. They told me to stop making payments and start with the New Loan. When I tried to pay they pulled back the loan and tried to foreclose. We filed bankruptcy in Feb 2009 to stop bankruptcy. We made payments up to April of 2012 when we noticed Wells was not applying any of the payments. We stopped making payments and let the bankruptcy drop. There is approximately $50k not accounted for that was paid to them by the court to be applied to the principal. We tried the HAMP through Wells Fargo and after 4 months of the perpetual document requests we were denied because they claim we only make $153.00 a month. Our house is now only valued at 170K and wells still has us owing 189K + $40K in interest and penalties with no sign of my $50K they were given by the court. I need a loan reduction, modification, penalties dropped because they have $50K from the last three years. We own two companies that grossed around $175K in 2012.
