Approximately 3 years ago I got a home loan from Countrywide, which was done entirely by phone and fax. After the loan was finalized Countrywide promised me my loan contract would be sent out to me within 30 days. To my surprise, two months later the Countrywide website changed and I was making an online payment to BofA. This worried me because I still had not received my loan contract from Countrywide. I started asking and continued to ask BofA for my original contract by phone, letter and in person. At one point I called BofA trying to make my home loan payment and again, requesting my Countrywide home loan contract, an employee working for BofA answered. I stated my name and said I wanted to make a payment and again enquired about my home loan contract. The BofA employee asked me to repeat my name, I said, "David H the person who has been making payments for the past 20 years." Her reply was, "I can't talk to you, this property is not in your name, it is in a Mr. Richard G's name." Richard is a longtime friend and roommate whom was equally as shocked as I had been to hear about Bank of America turning over the ownership of my home to him.

Mr. Richard G and I both tried, on many occasions, to ask B of A to put ownership back in my name (David H), as it was originally. Both of us finally decided to personally go into the bank to explain. Once we were in we were in the bank the manager told us they did not have loan representatives in the bank any longer. Then she took us over and put us on a speaker phone with a B of A home loan person. After explaining how the bank was making a big one the home and its owner, she told us that it doesn’t matter which one of you wants to claim or which one of you wants to disclaim ownership of the home. We at Bank of America are going to go by who Countrywide claims is the owner of the home at 316 Moorland Street. I asked if she would send Countrywide’s original loan papers to my home She Stated “Mr. G if you want this contract sent to YOU and ONLY YOU, you can write a detailed letter to B of A asking for the Countrwide contract”, then she hung up. Richard G and I both sent many letters requested by the woman at B of A. The B of A always replied to our letters are still being sent as of Dec 20 2012. I continued to make payments for over a year even though they were not sending me the loan contract to my home. About 3 or 4 months ago I finally told them I was going to hold their payments in another account until I got my copy of my loan contract from Countrywide. they agreed, they (BofA) continued to send me the letters. It was around this time that a woman named Lyn Rawlins from Asset Law Center (ALC) called and

told me ALC and their attorneys could get me a “30year loan modification at 2% for the life of the loan.” Furthermore, she led me to believe she was affiliated with BofA by making statements like, “I’ve been working with BofA for years now.”

At this point I felt it would be worth the $4500 she said ALC and their attorneys needed to accomplish getting the home back in my name with a 2% loan. A few days after I turned the BofA house payment money over to Lyn and Asset Law Center… That is… the money I was holding from Bank of America until I was given my loan contract. Which, to this day I have yet to receive. Lyn Rawlins and ALC told Richard and me that it would only work if we were to go on letting ALC think Richard G was the homeowner. Then she added after the 2% loan was finalized ALC will help us to do a Quick Claim Deed to put it back in my name.

On Friday Nov. 12th 2012 I got a warning from a realtor friend that she noticed my home address posted with a company named ReconTrust and it was to be auctioned off in two days (Nov. 14th), two days away. I went on line and was shocked that BofA had given ReconTrust the right to sell my house without warning Richard or myself. I called ALC to ask them what was going on. When I told Lyn about ReconTrust and the sale of my home she ask if she could call me right back. One hour later she called back and simply stated “Yes David, you’re right, your home is up for auction with ReconTrust and you and Richard are most likely going to be homeless in two days and that’s because you didn’t send use all the information we needed”, then she hung-up. This was totally false and she knew it! We had sent EVERYTHING requested at least three times because ALC kept claiming they had misplaced certain item we had sent previously. The First time I had ever spoke with Victoria Herrera (Owner of ALC), was the day before the auctioning of my home was to take place. She told us that Richard G needed to file for Chapter 13 Bankruptcy before auction time or we would lose the house. This gave Richard less than 48hrs.to file Ch.13. Mind you Victoria and ALC were well aware of the fact that BofA had arbitrarily changed ownership from me to Richard and now they were telling HIM to file Chapter 13 to save MY house. This whole mess was instrumental with a stroke Richard had about three months ago, at the age of 49. I just recently became paraplegic and in a wheelchair do to a spine disease I contracted during an operation for a hernia. Lyn, Victoria and ALC all knew of the multiple ailments between us both. Richard G, who is also my healthcare giver, has a bad heart. I, besides being in a wheelchair, am also a liver transplant patient do to non-alcoholic cirrhosis. I also have been fitted with a pacemaker.

There’s much more to tell about the horrifying treatment that Richard and I have had to endure. I’m writing this in the hopes that I can get some help from the A.G. Kamala Harris and this Consumer entity, It’s truly my last hope in saving Richard me and my three indoor cats from being completely homeless. I have owned my home for 20+yrs, and before Countrywide and the Asset Law Center took over, I had never missed a payment on the home in which I had always thought I would be living and dying. Like I mentioned all phone calls were on video sound track with all parties having full knowledge of this fact. I also have Victoria, owner of Asset Law Center, on videotape promising me my $4500 dollars back. Of course, now Asset Law Center is no longer accepting my calls and still, to this date, have yet to pay me the $4500 which, like I mentioned.’’ It wasn’t until after all this that I was told by the Attorney Generals office it was illegal. I AM ASKING FOR THE $4500 and now that I had to pay $3500 for a lawyer to claim chapter 13 bankruptcy to keep my home from being auctioned off at least for now. If not for keeping me uninformed, this possible loss would have never happened.

I, Mr. Richard G, as a worried friend and concerned caregiver to Mr. David H, cannot just passively stand-by while this man sinks into one of the deepest depression cycles I’ve ever witnessed. This is why I have sent the above letter that was in his hand, (sent with his permission). Never in my thirty years of caregiving have I seen a person sink this far into such hopelessness. He is so afraid for his 3 house cats and himself, I don’t know if he’ll ever come back to being the trusting, compassionate, happy-go-lucky individual he once was… Mainly do to Asset Law Center’s Lyn Rawlins and Victoria Herrera calling disguised as helpful caring persons… Then, all at once, not only made this gentleman feel so insecure about losing everything he’s built up in the last 50 years of his life. But also, they’ve added the probability of homeless for David and his cats. But, what’s really heartbreaking is how the greed of a few can take a happy compassionate human being from his friends by snatched the great qualities this man once had… and now turning him into someone whose even afraid of going to his doctor’s appointments for fear the locks on his doors will be changed by the time he’s brought back home. SHAME ON YOU!! THIS IS SO-SO-SAD!
