A little heads up for anyone dealing with Kelly Fontaine. Kelly Fontaine can go into a screaming fit all he wants. But a little does everyone know that Mr. Fontaine's has a loop hole with his company and so forth. If he refers you to any lenders and they do not close the deal and meet your expectations then he is liable for the money that you paid into him. Turn him into the attorney General. Mr. Fontaine is the biggest phony there is .. He will purposely take you as a client and he will also know ahead of time if you arent getting the loans. He will never tell you that he will take your money anyway...If you do business with him you might as well go buy a bunch of lottery tickets and take a risk that way because he isnt going to do anything for you....Luckily we recovered the money he owed us...Anyone with questions about Kelly Fontaine I will be more then willing to help. Brian,
I would highly recommend your using 24/7 Funding . Kelly & I have worked on a few deals already. He is very agressive and will oversee your files in keeping you informed and up to date on the current conditions. He does require a retainer fee that must be wired into his companies account. This retainer serves as a comittment from the borrower to the lender that they will follow through with there obligations under the terms of their approval. Kelly's team will go above and beyond the traditional method on finding solutions for your clients business. He has a variety of programs that are available up to $500,000,000 in comittments. I will continue to work with 24/7 in the future months. My personal goal is to close a $500 mill deal before the end of this year. Your compensation plan will be agreed upon between you both. Whatever compensation plan that you want to establish is what he will present to your clients. I am looking forward Brian to your working with Kelly. You will see that he is a straight shooter that is a no non-sense guy that favors the likes of Clint Eastwood's movie. He will tell you to Good, the Bad, and the Ugly parts of your deals but ultimately will win the gun fight and get them done.

  • Retainers versus Funders Due Diligence Deposits and Commitment Fees

We are providing the client with a specific funder who can offer financing to them based on the funders review of the representations made by the borrower with respect to loan size, geography, credit profile type and mix of collateral etc. The retainer paid to us by the borrower is not a deposit to be used for due diligence but rather an engagement fee to arrange for the specific financing.

We require this retainer to protect ourselves against situations where our borrower has inadvertently misrepresented the value of collateral or the cash flows to cover debt service. It would also protect us in a case where the funder finds they cannot perfect a security interest in the collateral being offered or the borrower cannot provide the necessary documentation that the funder requires.

Because we do not require any exclusivity with respect to our fee agreement, the retainer also protects us in the event that the borrower obtains financing elsewhere, secures an equity infusion, or simply decides that they do not require the financing at this time. If the loan does not close for any reason, other that our inability to produce a capable funder, then the retainer covers our time, effort and expense regarding the work done by us.
