I decided to use sellandrecycle.com after they offered the most money for my Droid X2 at $40. HOWEVER, when I finally decided to mail in my phone and they received it, they said it had a BAD ESN and offered $13.50. In my original email, there was a link in which if you clicked on it and declined the offer, the phone would be mailed back to you.

HOWEVER, I never received the phone. Plus after declining the offer, they emailed me two more times offering $20 and $30 for the phone so that was a red flag right there. I have yet to receive my phone back and the company has NOT responded to my emails.

Here is the original email verbatim (minus my name and ESN number):

Hello .....,

We have completed the value assessment of your items and determined that the speci?ed condition of some items do not match the original quote.

The Droid X2 was stated in GOOD condition, we have found this item to be in LIKE NEW condition.

The Droid X2 has a Bad ESN. Bad ESN Means: It is not possible to active this item with Alltel. The Droid X2 could have been part of an insurance claim, reported lost or stolen, have a pending balance or is still active.

Serial Number:
Market Value of CLEAN ESN:$44.00
Actual Market Value BAD ESN:$13.20

Therefore the new market value of your item is: $13.20

If you accept this offer please click on the "I Accept" link or "I Decline".if you wish to have your item mailed back. If you wish to fix the BAD ESN or have fixed it you can simply request a re-assessment and click on the “Re-Assess” link.

PLEASE NOTE: It is imperative that you accept or decline our offer within 7 days from todays date: 09/19/2012. After 09/26/2012 you will forfeit the right of accepting or declining the offer as stated on our terms and condition and we will simply release payment for the assessed amount sent to you on 09/19/2012.

I Accept | I Decline | Re-Assess

Thank you for choosing SellandRecycle.com. Where its not just selling, it's recycling.

I see that I am not the only person who has gone through this with this company so I don't feel so bad now. USell.com needs to address sellandrecycle.com because it ultimately makes them look bad backing a company with a history of ripping people off.

  • The company emailed me AFTER being contacted by Scambook and STILL wants to pay me $30 for the phone. How many times do I have to say I DON'T WANT YOUR MONEY. I want my phone back or a similar replacement.

You do NOT get people to send their phones and then keep them and/or give them peanuts for the phone. Until last week, SellAndRecycle refused to even respond to my emails.

Until I receive my phone back in LIKE NEW condition (or a similar replacement) this report will remain active.

  • Here is the emailed response from the company:

    Hello,

We send out your payment already via Paypal, and we have continued the recycling process. Unfortunately, we did not received an email reply from you, after sending you our last Courtesy Offer. Therefore, you have forfeit the right to accept or decline the Courtesy Offer at this given point, and you are legally bound by the sale transaction. We send you the the payment already, and you simply need to log in to Paypal.com, and accept/claim your funds.

    Thank you,

    SellandRecycle.com

So by their own admission, they are contradicting themselves by saying in the original email that IF you decline the offer your phone will be sent back to you. Even after I declined the initial offer and have written several emails saying I don't want their offers, they continued on with the issuance of the $30 that I REFUSED and took my phone.

Expect a money order in the mail and for me to pursue this issue to the maximum extent under the law.

  • Update: I also submitted a complaint to the BBB and here is their response:

16.5 SellandRecycle.com reserves the right to bill you for return shipping a payment of $8.99 on any item or items with a total quote discrepancy over %20 of the value that you were originally quoted based on your description of your item(s). This payment must be processed through money transfer services such as PayPal or via a credit card transaction. Failure to do so within 30 days of your decline of your counter offer will result in you the customer being legally bound by the sale transaction based on the assessed amount and not the original amount.

Basically their original email about shipping your phone back after declining the original offer is a lie and a scam to get your phone. As you can see in my initial post in this complaint, there is NO mention of this clause in the email just the statement of getting your phone back after declining the offer.

It also seems to me that after declining two offers after the original offer that I should have had my phone sent back to me. Then again, as I keep repeating, I should have had my phone shipped back to me after the original offer was declined as stated in the original email.
