International boundaries

1. On Oct. 12, 2010, Complainant was hit in the side while making a left hand turn, by a lady who ran a stop sign. State Auto, listed Complainant as at fault. And raised his auto insurance premunim by about $30.00 per month. Without providing Complainant an opportunity to appeal this decision.
2. On April 13, 2011, Complainant's car was struck by a lady driver. The Memphis Police listed two (2) diagrams on the Police report, and picked the one diagram that reflect that woman was not at fault, and ignored the one showing Complainat was not-at-fault.
3. Complainat, received the following citations: (a) Financial Responsibility law, and (b) Maintain Safe Lookout.
4. On Oct. 18, 2011, Memphis Traffic Court, Division 3, after listening to all parties and reviewing the Traffic diagram of the positioning of the cars, and damage to Complainant's car, concluded, that it would be appropriate to dismis all charges.
5. On March 15, 2012, State of Tennessee, Department of Safty And Homeland Security, Driver Services Division, Financial Responsibility, PO Box 945, Nashville, TN 37202, Phone 615-741-3954.
Stated: Based upon the information Complainant, Submitted and a review of the investigating officer's report, we have removed the points assigned for the cash on April 13, 2011.
6. On May 11, 2012, Darren Everett, Personal Insurance Underwriter, stated in part: Due to the circumstances of the accident and the police report we feel that you were at-fault in this accident and will be charged on your new auto insurance policy ATN0058387,$116.17.
7. Prior, to and on September 12, 2012, Complainant filed a complaint against State Auto, with State of Tennessee, Dept. of Commerce & Insurance, Consumer Insurance Services, 500 James Robertson Parkway, Nashville, TN 37243-0574, Tracking No. 33162, after exhausting their mediation efforts the case was closed.
8. On September 11, 2012, Darren Everett, stated in part that State Auto had reviewed the complaint concerning the Oct. 12, 2010, accident.
And, that it was listed as not-at-fault, no points and no charge.
9. Incontravention of Darren Everett's paragraph eight (8) declaration above, Complainant was charged as at-fault and points applied. On the new Progressive Auto Insurance Application, Driving History States, Please review the following information caredullly becuase driving history is used to determine your rate. All accidents are considered at-fault and chargeable unless the accident is under an applicable payment threshold or we receive additonal information from you or another source that proves the accident was not-at-fault. We obtain driving history from the following sources:
Your application (APP) Motor vehicle Reports and/or court data (MVR) provide by a consumer reporting agency; and Progressive claims history (PROG) Comprehensive Loss Underwriting Exchange (CLUE) provided by a consumer reporting agency

The problem is that Complainat should not be at-fault because Darren Everetts, feel this should be so. Complainant is not legally at-fault until a court rules that he is. Any ruling of fault by any other entity is not binding on Complainant. Darren Everetts, cannot act based on his feelings, or determination of fault, or require Complaint to pay anything based on their decision.
