My husband and I rented a townhouse from Mary Wilkes/aka Wilkes Property Management, at (Personal Information Removed)

When my husband's parents were both hospitalized unexpectedly in the end of July, I attempted to contact Ms. Wilkes to let her know we needed to go to the Midwest/Illinois, to help out asap. We would be moving out, and although Ms. Wilkes did not return phone calls prior to the 1st of the month, she stopped by the townhouse on Sunday, 8/5, as the rent was due and she wanted to be paid. We explained the situation to her and she told me to prorate the amount for the days we would be be there and send her the check to the Olympia Wilkes Management address. She said, at that time, that she'd return our deposit and any overpayment if we left before the amount of days I paid for. I did as she asked, and marked my check to her for the prorated August rent amount "as agreed." I sent, along with the check, an address for Ms. Wilkes to send our deposit refund, which she was required by state law to do within 14 days of our moving out. My husband and I put in a change of address with the post office on Aug. 9, and moved out Aug. 10, one-day earlier than I paid for to Ms. Wilkes. I left a phone message on the Wilkes Property Management phone number letting Ms. Wilkes know I'd overpaid by one-day and she could add the $27 to the $400 deposit refund and send it to the address I provided her with. My husband and I cleaned the townhouse (he is former military, so the unit was exceptionally clean. We even paid to get the carpets cleaned so there would be no chance of Ms. Wilkes being disappointed; however she refused to walk through the unit before we left. Also, when we moved into the unit in April the place smelled awful and was very filthy. We cleaned before moving in and added the carpet cleaning to try and remove that original smell, which Ms. Wilkes had left a fan and windows open to try and dispel when we first were to move in).
About one-month later, the beginning of September, Ms. Wilkes still hadn't sent the refund, so I tried calling her at the Wilkes Property Management number, as well as on her cell phone number, which she provided when we first moved into the unit. I called once a day, for the first week and then tried another number (listed on the message on Wilkes Mgmt. as an 'emergency number') as I was getting no response and no refund. I began calling each of the original two numbers once each day, and called Ms. Wilkes' cell number more often, as she would answer and then hang up without saying anything, and I wanted to be sure I was reaching the right number.
After a few weeks of this (with me leaving messages for Mary to please call me and/or return my deposit as she had promised, and eventually saying I'd hate to have to take her to court for my money if she was indeed stealing it) I received a certified letter from Ms. Wilkes along with a check for $200 that stated if I cashed that I was agreeing she owed no more money than that.
Ms. Wilkes said she wasn't paying the full amount because I "harassed" her. She claimed to have sent me a refund to the Lacey, WA address "the day after (we) moved out."
She claimed I didn't put a change of address with the post office (which was not true) and that she had "waited for me to call" to ask for the refund, which she claimed she took out of the vacant unit's mailbox).
Why she didn't send the refund to the address I provided, or send a refund within 14 days as she was legally bound to, or why she didn't refund the whole amount she previously agreed to, I don't know.
I have since sent her back the $200 check in a certified letter, (since in her letter she said she wanted all further correspondence to be through US mail) along with a demand for my $427 that she owed. However, she hasn't picked up the certified letter and is ignoring that as well as my previous phone calls.
I've turned Ms. WIlkes/AKA Wilkes Property Management over to the Better Business Bureau and hope they, or someone will make her (apparently) stop stealing money from tenants. Evidently she had no intention of refunding my deposit, and I can only surmise may do this to all her tenants who move out of state, because she (apparently) thinks no one will sue her to get their money back.

  • Hey I also have a complaint against mary would you Ruth be willing to talk to me? I have some questions for you.. or anyone who has issues with mary Wilkes.

  • This is Mary Wilkes. For the record ... Ruth did not get her deposit back because she broke her lease, and therefore is not legally entitled to it. She did not honor the contract that she signed. And she broke the law. She failed to comply with Washington State's Residential Landlord-Tenant Act RCW 59.18.200, which requires the tenant give a minimum of 20-days notice.

    I was willing to give her her deposit back at one point, though, because I felt sorry for her. She told me she was moving to Illinois to take care of her husband's ill parents. But she, apparently moved to California, not Illinois. (Her new address is in California, and she keeps talking about flying "up" to Washington.) She did not get the check I sent because she did not put in change of address like she was supposed to. Then, she became rude and demanding. She started calling incessantly, and posting lies about me on the internet.

    Ruth did report me to the Better Business Bureau, but they dismissed the complaint completely. Ruth keeps "threatening" to sue me, but she fails to understand that I would be happy to settle this complaint, or any other, in court.

    As for "nastymomma", I assume it the ex-tenant, whose initials are A. N. As you can guess from her screen name, she was a less than ideal tenant. She told me when she moved in that it was just going to be her, and then promptly moved in her boyfrend, who I never would have rented to. They were loud and the boyfriend kept making rude remarks to the young women who lived in the building. The other tenants in the building requested that I terminate her tenancy, which I did. She and her boyfriend got mad. They started pulling bricks off a small retaining wall and throwing the bricks on the lawn. Then the boyfriend drove over the wall with his truck.

    Perhaps if Ruth and "nastymomma" started treating people with a little more respect, they would have less to complain about.

  • Mary has lied about a lot, especially about saying we broke the lease. I tried to reach her by phone several times prior to Aug. 1, but she wouldn't answer or return calls. When we finally connected on aug. 5, she agreed to return our full deposit plus any overages if I prorated for the days we would be there. I did so, and wrote as agreed on the check, which she cashed. She is now saying we were lying about my husbands parents both being in critical conditioning the hospital, which is why we left to go to Illinois. We had to return to the west coast for work, and Mary still hadnt returned the deposit of $400 and $27.50 overage. So, I tried to call her again. She wouldn't return calls again .... Anyway, my husband's mom died back then, and his dad just died this week. Mary has been despicable to us during this and has stolen our money. That's all there is to this. She appears to be a thief who has probably done this to others.

  • Oh yes, and as for the better business bureau, the case is not closed, as Mary knows, it won't be closed until she does right and returns our deposit an d subsequent expenses, including the partial return check which she stopped payment on.

  • By the way, Mary, we were in Illinois after we left Washington, spent time with Mark's parents, returned to the west coast, now are back for Marks dads funeral this week. We will return to the west coast again after that. I never said we were moving to Illinois, just needed to get there because both parents were in the hospital. We couldn't keep paying rent in Lacey while having to go spend an undetermined time in Illinois, which you said you understood at the time.

  • Yes, I recently moved out of her place I believe in November. And still to this day have not gotten my last month or deposit back. She won't answer my calls. She talks to other tenants about my money. I was not able to provide Christmas because she choose not to give my money back.

    Thanks Mary. She tells other tenants business, she favors a certain tenant over everyone and that tenant makes it known that she favors her. She allows them to have 10 cats a dog in those little apartments. She let's other tenants decide who she evicts. When my bf and I moved in the place was nasty. My old man had to fix the outside light cause she wouldn't fix it.

    Mary is a slum landlord!! Ruth what apartment did you live in? And do you have a way we can chat so Mary isn't being nosy?

  • I am so sorry for you and your husbands loss.. Why haven;t you taken her to court? She had us in a month to month and her favorite tenant told me the other day when I was there "looking" for Mary that Mary doesn't do leases!

  • We were in the last unit before the other landowner's property. The unit was filthy when we moved in but we scrubbed it and then cleaned and had the carpets cleaned before we left, so there was NO reason for her keeping our money. She lied and promised the deposit back when we left. Anyway, I guess you know how she is. What unit were you in? You can contact me at (Personal Information Removed)

  • Good evening,

    Recently it had been brought to my attention that I was part of a complaint/rumors being spread about Wilkes Property, so as I was browsing I found this complaint.

    First of all Ruth or Momma my name is Jennifer Menish and have I spoken/emailed/corresponded with either of you prior to this moment now?

    I see that you both are "angry" with Mary and in all honesty I don't care why your not living in her apartments. I have lived here for 11 months and have no complaints. When my partner and I were moving due to my neighbor tried to kick my door in at midnight (hate crime)we were desperate. I have a illness that some days make it impossible to get out of bed. Would I have picked this place if I had more time-no. NOT because of anything other then space.

    Recently Mary and I had a miss communication about a maintence thing. Yes it was a little hard to work with her because EVERYONE sees things different, but it was nothing that warrants what seems to be a hate fest.. My mom always told me there's your truth, my truth, then the real truth..

    Before you go casting stones just remeber she gave all of us a place to live and for that you should be grateful.One thing I have learned from Mary, is if you're upfront she is willing to work with just about anyone.

    thank you for reading. I just wanted to clear the air to whoever might be renting a place and find this stuff. I do want them to see that some place are just not suitable. Doesn't mean there bad people just not compatable.

  • Another thing is momma is Andrea your grounds for harassment were not needed. I know I can be diffcult at times, but you and your man were unruley. You both blarred your music, yelled, drove on the grass, cut down trees, made sexual comments at young girls here, etc.. And you lived here such a short time *tisk* I really don't feel like you have any grounds to be angry at anyone. Just saying.

  • Jennifer, no one is saying you are in any way involved in this matter. It is not just a matter of people 'getting along' it is a matter of Mary Wilkes not returning our deposit, which she claimed she would do, and then saying she sent it, when the letter was not forwarded as the post office was instructed to do. She also put a stop payment on a partial return of that money, which caused additional expenses. You are in no way involved in this.
    Also, you say Mary 'gave' us a place to live. This also is not correct, as she received more than $1000 a month to 'give' us a place to live, in what amounted to filthy and slumlord conditions. We didn't complain about those conditions, so they also are irrelevant, as are your unrelated comments. If you and 'nastymomma' want to discuss your problems with each other, feel free to do so elsewhere. Thank you.
