We are filling a complaint against both Festiva Adventure Club and their Sales Representative Michael King.

My husband Kenneth and I attend a TimeShare Presentation around December of 2011. We were told that the purpose of this timeshare presentation was to help those of us who wanted to rid ourselves of our timeshare by taking them off our hands. Ken and I were trying to get rid of Coral Reefs Resort Shipyard Plantation in Hilton Head, SC and the Pelican in Saint Martin.

Michael King were assigned to Kenneth and I as our Sales Representative.

During the course of Michael's presentation he told us that Festiva would take both of our timeshares if we would join their Adventure Club. He pointed out to us that assessment and Maintenance fees for both our timeshares would be due soon.He further pointed out that assessment fees for 2012 would be astronomical; therefore, we should make a move before January 2012.

My husband and I returned home that night, discussed it and return to their presentation the following night as promised.

Upon our return, Michael told us that if we joined Festiva Adventure Club they would do the following for us:
(1) In addition to taking Hilton Head and Saint Maartin of our hands, they would pay the assessment and maintenance fees for Hilton Head and for Saint Maartin ( They did not take Hilton Head. They only took Saint Martin. I paid $920.00 for Hilton Head )
(2) He also told us that we would have no assessment nor maintenance fees for Festiva Adventure Club for year 2012 if we joined that particular night. ( Not true. We paid $955.00)
(3) He further told us that we could put our vacation slot up for rent each year and NEVER have to come out of pocket for maintenance and assessments fees if we notified the Sales Department in September of our intensions. He further explained that the Sales Department would deduct our fee once our time slot has been rented. He also assured us that there has never been a time slot not rented. ( A few months later I contacted Sales Department and was told that 2013 fees must be paid before I can put my time slot up for rent )

(4) He also gave us his email and phone number in the event we got home and still had questions.
(5) I tried on many, ocassions to contact Michael to no avail.
(6) I conact supervisons from the company but got "the run around."
(7) I reqested the name, address and phone number of the company's President and CEO but was told that they could not release that information.
(8) todate I have paid $955.00 assessment and maintenance fees $974.00 toward a $5800.00 loan and $920.00 for Hilton Head's 2012 assessment and maintenance fees
