I purchased a Nikon camera via Amazon gift card. At first, communication with Bytems was very good (which should have rung a bell). But when delivery day came and went (July 3rd), I asked to cancel my order and within a week, they stopped communicating and the website is down. Does anyone know what would happen legally if I were to cancel my Visa charge to Amazon?

  • Hi, Laurie! You're not alone. I contacted Amazon.com about what happened and received an email back from them asking for more information as to what the gift card code was, order number, etc., as if they didn't already know. Anyway, I sent that info and they wrote back that they were just so sorry that they couldn't help me by giving me the information as to how that card was redeemed and by whom. I wrote them back and told them that I know their company is mentioned in a lot of these types of scams. I didn't know about this type before this happened to us. I'm embarrassed, but I am going to report it to my state's attorney general's office and the FBI. Have you filed a complaint with any others over this? I wanted to dispute the charge to Amazon.com through Visa, too, but I just read their policy and it has to be a charge that isn't authorized. I authorized the charge. If we both dispute the charges, even though we will be more than likely refused our money back, they may have some contact with Amazon.com and maybe that will be helpful. If they get enough of these stories, they may be able to better flag this type of thing. I wish they would put all of our complaints together. There are several now. It seems that this "company" must have been open in June, ripped us all off, and have take off. Their fax number we tracked to a place in California, not Birmingham, AL. Good luck! Are you going to dispute the charge then? Carrie

  • I had the same response from Amazon. And actually, as far as they are concerned, I cant complain to them. Their website specifically claims to not make returns on gift cards (which they pointed out to me in their email). Plus, the transaction which I made with them was carried out as requested. How would they not know I was just gifting a person and not a ficticious company?
I did report it to the FBI and I am contemplating contacting my bank. Doesnt VISA have insurance for cases like this?
This is very upsetting and the last time I ever purchase anything not through Paypal....
Will keep you posted and please let me know if you get anywhere.
    all the best, Lauri

  • Lauri - It looks like they're setting up again in Ohio. I have an address for them at 5329 Rentschler Estates Drive, Hamilton, OH 45011, no phone number yet. But their "reviews" are starting to show up again, one place is stlshopper.com; another is bloglineslocal.com, merchantcircle.com, PR usa.net. When I click on the website address, I get the message "cannot display this page." But my Norton program says it's a legit business as does Bizrate. Yes, they're on bizrate, too. Maybe they're making up their own pages for these places. It's just so weird. I really hope you get this message. I find it difficult to communicate on here and haven't received any info at all from scambook. What's up with that?

  • if you google that address, it shows a residential home. i think it is an old listing, as the link on those websites do not work. i dont think Scambook is proactive in any way, they are just a "bulletin board" for people to vent.
anyway, i dont see any new complaints lately and I havnt got a clue as to what, if anything we can do.

  • Hi, Lauri - I called the Missouri Attorney General's Consumer Complaint Division and was told to do the formal on-line report. I did that later. But she did a check on them and found that house, too. She said the other place in Alabama is a warehouse for storage. She checked with the Better Business Bureau and didn't see that business. It just doesn't exist. I tried to do a dispute on the charge last night, filled out the reason for the dispute, the amount, etc., and then when I hit "submit," nothing. I was disconnected from the internet. Then I went back to the site and it said "Site is temporarily unavailable." It gave me that message all evening. I'll try again tonight. I did submit a report to the FBI. I wrote to Norton asking them if they shared any liability since they marked it as a legit business and haven't heard anything from them yet either. I think ALL we can do is the dispute with the credit card company. At least that will take our money back from Amazon.com and the company will hold the funds until after the credit card company does an investigation. Even if we don't get our money back, someone will be investigated. Are you going to do it? The gal at the AG's office told me to yes, definitely do that. I will try now and see what I get this time!

  • Lauri - Sorry to be a pain, but I wanted to let you know that I did dispute the charge and the credit card company said to continue to pay on my CC bill but not on that charge. They are going to open an investigation. I think they may want anything you've printed out from Bytems.com should you do this same thing. I'm getting all of the papers in order and ready to send when they ask for it. Please do go ahead and try it. At least you'll get your money back -- for a while. I noticed one or two did this and got their refund. YOu were right all along to think that's what we should do. Let me know what you find out. Thanks!

  • you are not a pain at all and I will call my cc company and dispute the bill today....will let you know later what they said. i am puzzled, though, as Amazon is basically covered here - they provided the service we purchased so theoretically we have no right asking them for our money back. The only interest they have in cooperating is if we threaten to publish that they work with criminals....

  • I just saw a comment on one of the complaints that he did receive a credit from his cc company and so I thought it was worth a try. I selected that charge and selected that it was to be shipped, not picked up, and I described the item and then put in my explanation that Amazon wouldn't disclose the info I need in order to find out who redeemed the card and how. I rec'd an email later that gave me a case number and they said they were going to do an investigation. At least I found someone who will investigate it. It is worth a try, and I understand what your thinking is. Let me know what happens with your cc company.

  • Hi again - I received another message at 2:30 this afternoon from my cc company. They advised me that they issued me a refund for my $700, that I am to consider the case closed unless I hear from them. They said that the "seller" has 45 days to make a claim for that money. I wish upon a star that they don't, but I can't imagine it going that way. The bank said, "Then we will proceed from there," so I'm hoping their fraud division will assist me in some way??? I just wanted to let you know that I did get my refund -- so far anyway.

  • Lauri - I also contacted Norton because their program had check-marked "legit business.". They wrote back and said that isn't what that means. So I told them that I ended up having to do a complete recovery of my laptop because of a virus they didn't catch and that I loaded new software that is a lot more in the ball than Norton and that I felt they had some liability in this deal as well. Now they have written asking me for two contact numbers and a time to call me because this issue is going to someone "at the top" to check it out more thoroughly. Just think about all of the components involved that caused us to make that horrible decision and contact them all. Pls let me know what you find out. My cc company is Capital One. By the way.

  • Oh, no. That's just terrible! No, we haven't heard anything yet and our cc company still shows the credit. Have you filed a complaint with Amazon.com? I received a letter from the Missouri Attorney General's office and they said they wanted to help me and so they said they would contact the company and see if they can get this issue resolved. Okay. I have a "seriously" here, too! I'm so sure they will find a company with open doors when they contact them!!
