This is the letter I sent to CapitalONe in regard to my complaint:

I am angry and about to close out both my CapitalOne personal and business credit card accounts.


A fraud was committed upon me and your Fraud Investigator, Kevin A. (gave no last name) just sent me a letter stating that he saw no fraud and was sending my complaint over to the 'Disputes Department'. That satisfies me in no way. This is not a dispute but a scam/fraud that I challenged. Facts: A while back I saw a MedCHelp ad online that raved about their diet pills. I thought since I am a diabetic and could lose some weight I might be interested. In their ad they said they would supply a sample of their pills to me for free with the proviso that if I did not want them I could notify them within ten days of my receiving the sample supply and pay only a small $8.95 fee if I decided not to buy further orders. If I did not notify them within ten days after I received the sample order them I would automatically get a delivery of these pills each month at a cost of $49.95.


I did not receive the sample until 15 days after the initial contact. I called them five days later and told them I was not interested. I was then told that the 10 day trail period had passed and I was obligated to honor the 'contract'. The only part of any 'contract' was my giving them my credit card number to which they could charge for further pills should I opt to receive them. Mind you the ten day trial period had already passed when I received the sample bottle. I told that to the woman at MEDCHELP I accessed on their website. She was not only obstinate but extremely rude.



Since I never received an order invoice I called the MEDCHELP number listed on the credit card bill. I told the woman on the phone that I did not want the pills -and even offered to send back the samples to which she replied, "not necessary". I also told her I would not pay for any further shipments but would pay for the sample since I was not taking advantage of their product. The pills were charged to my credit card account twice: first the the $8.95 for the sample to which I agreed (and that would have been free if I had elected to receive further orders) and a charge of $49.95 for the pills I cancelled and NEVER received. I explained this to the woman on the phone and she arranged for me to be sent a check in the amount of $49.95 as repayment for the credit card charge which I did receive. I have not received any pills except the sample but am now being charged each month for pills I had cancelled and never received. I even was even on the phone with a Capital One Representative and he made a conference call to the company. He heard them tell me my order had been cancelled.


So now my question is: With your representative having clarified the order cancellation why am I still being billed. In fact your representative suggested I get another card number so this would not happen again. I agreed and the new card is now in my possession.


Should this bill not be corrected and I not be given credit on my CapitalOne card I will not only cancel the credit card but will send a copy of this mail to the State Attorney General's Fraud division. I have excellent credit and don't want a matter like this which I consider fraud to mar that credit.
