78 y/o grandmother with alzhiemers taken to Mercedes Benz dealership with 50 y/o married immigrant. Despite her dementia ,unstable gait and obvious difference in age, and on fixed income. She was scammed into signing for a new 350 R Mercedes Benz for this Indonesian male for greater than her monthly income. He promptly stopped payment in 2008 and demanded her life savings for taking it out of repossession so he removed her IRA and payed Mercedes. He then stopped payment, never returned the car on in 2009 or return date of 7/10/11 and Mercedes did not repossess the car. It is now 2012 and Mercedes Benz is wanting the entire cost of the car which will bankrupt and cause a 83 y/o alzheimers victim to lose all her possessions and home. She also owes in excess of $4,000. tax penalty for the IRA funds of $16,000 that were raided to pay for a luxury car. She was under a doctors care receiveing cancer tx when this occured. Mercedes states she has to be deamed completely incompentent in 2007 to avoid payment . She was on a fixed income, had borrowed money on her home to pay bills and was scammed out of her life savings through fiduciary elder abuse . Dont expect Citibank,Mercedes Benz Financial / sales persons to have any simpathy. The Mercedes Benz dealership told me the only thing that would stop a sale despite the obvious disability, mental incapcitation, balance deficits and obvious age difference would be if her bank accounts had been frozen. So you can legally steal a car and rob a bank , just get the next dementia patient coming out of surgery for breast cancer and defer detection by family members for 3 years and you can fully abuse an elder its okay.
