We had a new home built,completed and closed on June 7th 2011. It was required by the developer that (3) trees be planted by the builder on every new property; we moved in on June 13th 2011 and by June 20 we noticed that one of the trees was dying. We notified the builder and someone was sent out within a week, he reviewed the situation and said the just needed more watering which we did.By June 30the tree was completely dead. The builders Onyx Homes told us that they dont warrranty trees so it was out of their hands. It is obvious that the tree was half dead before we closed and and there are no other dead trees in the entire subdivision on homes buile on or about the same time as ours. There are at least 6-8 built at about the same time as ours. Therefore, it has to be the builders responsibility to replace the tree which they refuse to do. The other (2) Trees are very much alive and doing quite well. which shows that something was obviously wrong with the one tree that died.
