In August, 2015 I applied for the American Express Business credit card. The offer included a $300 statement credit if I charged $1,000 on the card within the first three months. In addition, the offer included a 0% introductory APR on purchases for nine months.
The offer also included 3% cash back on the category of my choice from a list of selected categories. My application was accepted and I received the card the first week of October, 2015.

I went online, selected my 3% category, and received 3% cash back on my statements. In addition, my charges to this card received the interest free period as promised in the credit card application/offer. I also charged over the required $1,000 to receive the $300 statement credit. However, when I had not received the $300 credit by November, 2015, I called American Express customer service.

I was told by the customer service representative that on November 25th, I had reached the $1,000 charge requirement to receive the $300 statement credit requirement, and that I could expect to receive the credit within the next statement period.

When I did not receive the statement credit as promised, I called back in December, 2015. During this call, the representative confirmed that a statement credit was due, and suggested I give it more time.

I called again on January 9, 2016 when my statement still had not received the credit. The representative again assured me that the $300 statement credit was due and stated that she would issue an investigation into the matter. She asked that I call back in a couple of weeks.

When I still had not received the statement credit in February, I called back on February, 5th. That time I was told that American Express was happy to begin an investigation into the matter. When I told the representative that an investigation was started on January 9th, she replied that no investigation was noted in my file. The representative suggested that I call back in six weeks.

Tired of getting nothing but excuses and delays from American Express, I told the representative that I wanted to close my account. The representative told me that if I closed my account, that I would not receive the statement credit - that my account had to be active in order to receive the credit. The representative began another investigation.
At that time, I began to file complaints against American Express for false advertising with various credit agencies, the Better Business Bureau, the Consumer Protection Agency, and other interested agencies.

On February 4, 2016, American Express issued a letter indicating that because the "RSVP code" was not linked to my application, that I was not entitled to the $300 statement credit.
Here's the problem with American Express' response letter.

First, it is untrue and nothing more than an attempt to conceal their false advertising practices used to obtain financial gain.
Second, I opened this account with the sole intention of using the card to pay for a week long continuing legal education class that I had to attend in November. The total cost of the class and the hotel stay was well over $1,000 and I wanted to lessen my expense by deducting the $300 statement credit. I already have business credit cards so there was no reason for me to open another. (I also already have two personal American Express cards).

Third, I verified with the representative at the time I applied for this card, that the November charges would qualify for the statement credit. If the charges did not qualify, then I was not interested in opening the account. The representative verified that the proposed charges would qualify. I gave her all of the information from the credit card offer, INCLUDING THE RSPV CODE.

Fourth, all of the other offers included on the application/offer have been honored by American Express.
I received 3% back on my chosen categories.
I received the 0% interest on my charges until August, 2016.

Lastly, the card I received matches the advertised card exactly.

Fifth, the only part of the offer that American Express refuses to honor is their advertised commitment to issue a $300 statement credit. In fact, it was only I began filing complaints against American Express for false advertising, that they concocted their preposterous position that a code was missing so they no longer have to honor what they advertised.

Sixth, American Express indicates in their letter that one of the representatives I spoke with provided incorrect information regarding the promotion. However, they fail to reference the four other representatives that I spoke with beginning last October - each one verifying that I was entitled to the $300 statement credit.

Lastly, American Express does not indicate that I did not earn the $300 statement credit, instead, they now argue that because of an alleged technical error on their part, they are no longer obligated to issue the credit.

American Express falsely advertised a $300 statement credit in order to obtain my business. I want the credit immediately issued in favor of my current statement.

It is ridiculous that I have had to go to such lengths to get American Express to honor their advertised commitment included in their business credit card offer. I sincerely doubt that I am the only consumer that American Express has taken advantage of through this offer. I just may be the only consumer willing to fight for what is right.
