Job has been divided in 5 batches. l was delivering 2500 words each day. According to Serena emails proofreaders were working everyday on batches. By the end of day 5 upon receiving of the last batch Serena Foschi of Virtualelingua - told me that translation was low quality so she would not pay me.

Serena Foschi has 5 days everyday to see the job quality and tell me to stop translating and find another translator.
5 DAYS. But as soon as she received the job at day 5, in two hrs –NO l can’t pay you bcs low quality.

Instead she waits until day 5, when l delivered even the last 2500 words batch to say that.
Proofreaders could see the quality from day 1. She could as well. She waited to receive the full job instead.

When l’ve asked Serena Foschi in email she stated she used my version. She did not hire another translator for a new translation.

During this period l was contacted by several other translators who complained on the fact that she plays these games once she has the job delivered. But this is not my business.

Indeed in a single day (July 8) she made me several proposals on payment. Pls see below and laugh

WHEREAS IN FACT
1. On 11 July 2012 the plaintiff / claimant company Margherita srl. (Buyer and for the sake of brevity hereinafter called also “Margherita” ) has entered into an agreement (Doc. 1) aiming the "delivery, installation and commissioning" (otherwise the completion of all the commissioning activities for each turbine) of 6 Wind turbines (WTG model 3000 / 113/90HH intended for Wind Farm/Park known as "Deliceto 1") with the company Sinovel Wind Group Co. Ltd. with its registered office in Beijing, China, Culture Building no. 59 in Zhongguancun Street, Haidian district (supplying/providing party and for the sake of brevity hereinafter called also "Sinovel").

2. Subsequently, on December 5, 2012, the same company Margherita srl. (Buyer) entered into another agreement (Doc. 2) intended for the "delivery, installation and commissioning" (i.e the completion of all commissioning activities of each turbine, as part of this contract which together with its Annex, is composed of full 72 pages, 21 chapters, 47paragraphs and 13 Accapi (refer to Annex 13 of the contract and its respective index) for other 14 Wind turbines in addition (WTG model 3000/113/90HH intended for the wind park/farm known as "Deliceto 2") always with the same company Sinovel Wind Group Co. Ltd.with its registered office in Beijing, China, Culture Building no. 59, in Zhongguancun Street, Haidian district ((supplying/providing party and for the sake of brevity hereinafter called also "Sinovel").

3. More specifically, therefore, with the aforesaid two contracts, having the same content, Sinovel comp. is committed to provide for Margherita a total of 20 wind turbines ( for both parks " Deliceto 1" and " Deliceto 2 " authorized in the countryside of Deliceto (FG ) in "Viticone" district (contrada ), assuming a number of obligations: the commitment has to do primarily with (but not only ) the supply of the wind turbines at the site (i/e at the place in the Deliceto countryside, site which is intended and authorized for the construction of the Wind Power Plant), covering the process of delivery, transportation, on-site assembly, commissioning and testing of each wind turbine, installation of SCADA computer system of turbines’ remote monitoring and control, as well as the maintenance and operation/proper functioning of each turbine for a period of two years from the turbines’ Taking Over procedure, i.e. from the acceptance of all the wind turbines and Scada System (Article 1 of the two supply contracts ).

4. Namely, for a total amount of € 50,430,000.00, plus VAT, Sinovel has taken multiple obligations including those governed by Article 9, entitled "Test on completion and taking over": that is, the activities of completion and acceptance of each turbine and SCADA-systems for remote monitoring/control of wind turbine themselves (specifically, section 9.1 regulates "Start-Up, Commissioning and Test on Completion" activities, paragraph 9.2 regulates the activity of "Taking over of the Wind turbines", and finally, Section 9.3 " SCADA System and Taking Over").

5. More specifically under the aforementioned contractual provision, the work plan would have to comply with the following time schedule. The Start-Up (ie the commissioning of each turbine following the completion of the procedure indicated in Sinovel’s manual) should have begun upon completion and installation of the turbines, requiring as well the presence of a Technical Consultant (known as Technical Advisor) chosen by the Buyer in the person of Nicola Dattoli. Moreover the Supplier/Provider, should have notified with a five business days advanced notice, the scheduled date for the Start-Up and Test on Completion, taking into account the dates indicated in Annex no. 4 of the contract (containing the Program of Delivery). Following the commissioning of each turbine, therefore, the supplier/provider was expected to send the Start-Up Report for each turbine, i.e the report issued jointly after discussion and in agreement with the buyer with the aim to certify the completion of commissioning operations for any of the turbines. After the Start-Up Report delivery, the Test on Completion for each turbine would have started, as expressly provided for in detail according to Annex no. 13 of the contract (under the name"Test on Completion").

At this point, therefore, all the Commissioning activities for each aerogenerator, would be completed, i.e all the procedures and tests to check the proper functioning and operation of each piece of equipment, according to the aforementioned Commissioning manual in annex no. 13 of the contract, which constitutes an integral and substantive part hereof.
Pursuant to the agreements and following the finalization of the “Test on Completion” for each turbine, the Taking Over procedure would run, i.e the acceptance of each wind turbine. Following this acceptance, both Supplier and Buyer must sign for each turbine the corresponding Taking Over Certificate, as provided for in detail once again in Annex no. 6 of the contract (so-called " Taking Over Certificate "). To this end, therefore, the Supplier/provider shall notify the Buyer, with an advance notice of seven business days, the expected date for the signature of the aforementioned Taking Over Certificate for each single turbine.

In any case, the signature of the Taking Over Certificate does not relieve the Contractor of the liability to remove or fix any shortcomings/defects of the turbines during the Warranty Period.
Finally, as anticipated, the supply contracts (9.3) also regulate the completion and acceptance of SCADA system, that is, the computer system for remote control /monitoring of all wind turbines (in accordance with Annex No. 1.10 of the contract). As a matter of fact, once the SCADA system becomes operational in accordance with Annex 12 of the contract, the system is ready to be delivered (for its management) and the Provider shall forward to the Buyer the Taking Over Certificate of SCADA system.
In any case, the signature of the Taking Over Certificate does not relieve the Contractor of the liability to remove or fix any shortcomings/defects in the SCADA System of the during the Warranty Period.

Ultimately, for a substantial amount of more than fifty million euro, Sinovel is committed to provide to Margherita a total of 20 wind turbines fully-functional in a workmanlike manner, (i.e in accordance with the best working standards) as per technical specifications set out in detail in the contracts and in their numerous Annexes which constitute an integral and substantive part hereof: everything in accordance with the precise and detailed time table and work plan, which is also specified in detail in the contracts and specific annexes.

In particular, Annex 4 of the first Contract (Deliceto 1) (Doc. 1), has provided the conclusion of the commissioning for at least two wind turbines by 30.11.2012 and the completion of commissioning for the remaining four wind turbines by 15.12.2012.
Annex 4 of the second Contract (Deliceto 2) (Doc. 2), has provided the conclusion of the commissioning for the first seven wind turbines (aerogenerators) by 10.4.2013 and the completion of commissioning for the remaining seven wind turbines (aerogenerators) by 25.4.2013.

FURTHERMORE IN THE FACT THAT
6) Actually numerous undertaken obligations are disregarded by the providing party that has defaulted both of the contracts entered into and signed:, currently, the described contractual activities related to the commissioning of the wind turbines have been improperly suspended.
In particular, the following has happened:

A - As of today the Start-up procedure concerning "Deliceto 1" has started with four months of delay and has not yet been completed, although it had to be completed by 15.12.2012, while the start of Start-up procedure related to "Deliceto 2" was not even announced/ communicated regardless of the fact that not only should have begun but already supposed to be completed seven months ago (25.04.2013).

Indeed, only through an e-mail dated 30/05/2012 (Doc. 3), Sinovel informed that, according to the aforementioned clause no. 9 of the contract, would have started on 05/06/2013 the Start-Up and Commissioning procedure of the park (so-called Deliceto 1, mentioned in the first contract (Doc. 1).
Moreover Sinovel asked to the plaintiff/claimant company to appoint its own representative who, along with their site manager would conduit the activities, prior to the organizational meeting to take place before 05/06/2013.
B- Through an e-mail sent on 01/06/2013 having the signature of the Technical Advisor Eng. Nicola Dattoli appointed by the Buyer (Doc. 4), the latter has replied to the previous e-mail requiring to Sinovel the beginning of all the Start-up procedures on 06/06/2013 and has proposed 04/06/2013 as date for the organizational meeting with the aim to discuss the procedures for commissioning and operational details.
Indeed, the commissioning manual, an integral part of the contract as well as its Annex included, is composed of 72 pages, 21 chapters, 47 paragraphs and 13 Accapi (see annex 13 of the contract and its index).

It provides the reports of proceedings for each wind turbine, its specific features as well as all the controls and tests carried out by cross-examination according to the sequence specified therein, in order to verify that there are no constructional, mounting and functional abnormalities.
For example: control of the electrical connections, verification of the safety devices (brakes, adjustment of the blades, emergency stop for voltage drops on the network, etc. ..)
verification of the cooling systems, verification of the batteries (UPS) etc. ...

In addition, Margherita has required to Sinovel to deliver two days prior to the scheduled start date of the Start-Up procedure, the Commissioning manual compiled in Chapter 105 (in particular to the pages 11 and 12 where it is specified the serial number of the aerogenerator (wind turbine) and each of its components), plus all the necessary technical documentation (drawings, diagrams, ...) in order to correctly identify the equipments mentioned in the said manual.
Furthermore a work plan was required and Eng. Nicola Dattoli was indicated as a Technical Advisor for Commissioning.

C- An e-mail sent on 05/06/2013 (Doc. 5) has notified Sinovel on what was discussed and agreed upon in the meeting held on 04/06/2013, in particular, before the beginning of the Start-up procedure it is required:
- to have the commissioning manual completed in Chap. 105;
- a formal statement by Sinovel, certifying that the parts of the said manual,
(that Sinovel itself was not able to examine on site jointly with Margherita), are in accordance with the values and inspections shown in this manual, in addition to the same compiled parts of the manual;
- All necessary technical documentation (drawings, diagrams, ...) in order to correctly identify the equipments mentioned in the said manual;
- Finally, for each turbine, all the documents listed in the "Quality Assurance" chapter of the commissioning manual have been required.

Therefore, with the aim to enable the smooth running/performance of commissioning, i.e. of all the turbine’s control/monitoring and verification activities.

To conclude, turbines’ service manual has been required.

D - The e-mail of 11/06/2013 (Doc. 6), was a response to the previous e-mail urging Sinovel to send the required documents as well as the work plan. In addition, it was requested the delivery of the Scada manual.

E- By e-mail dated 13.06.2013 (doc. 7) Sinovel stated that it would send Scada manual on the following day and that company was proceeding with the preparation of the remaining documentation required for Commissioning. In addition, it expressed its opinion of being able to start the commissioning even without the required documents.

F- Through an e-mail dated 06.13.2013 (doc. 8), Margherita insisted that it could not assist the commissioning phase without all the documentation necessary for this purpose, but in any case, made itself available to assess the available documentation that Sinovel had sent.

G- On the e-mail of 14/06/2013 (Doc. 9), Sinovel informed that their Site Manager, Mr. Hao Jinjian, would provide the required documents on 17/06/2013. In addition, company has attached to this e-mail, Scada’s use manual.
