Breach of Contract, Failed to do the job, refused to refund good faith desposits, even though he admitted he failed and had no excuse. While attending the Mpls Boat show this past January 2011, we met with Jason Bartlett from Lakeside Upholstery, we showed him pictures of our seats, a photo of how we wanted them done and explained everything in as much detail as we were able to. Jason said our project was simple and very easy to do. Jason wrote up an estimate, we were so surprised by the total that we questioned the quote, repeating back to him in very specific details of what we were asking him to do. Which was replace all the vinyl on our 4 seats,replace foam on one of them and convert one seat to have 2 roll up portions, plus two small side rests and the quote also included removing the seats and installing them after completion. During this exchange Jason's wife said just bring your boat up and we will get the cushions then. Our response was that our boat was 11' wide and can't be moved without a special permit so you would need to come to the boat to pick up the cushions and install them, essentially have Jason remove and install the seats. Jason stated yes - the quote covers that too,and just to make sure we were all on the same page,we asked him to complete one seat and send us a picture so we could make sure, that the seats were being completed exactly how we wanted them, he agreed he would do that for us,and that is when we gave him an initial deposit of $350,he stated our job was first on the books the first week in March, and the job would only take 15 hours,2-3 days. Since that initial contact,Jason called me a few times right away after the show,asking when he could come and pick up the seats. I explained to him that our boat was under canvas for winter storage, but if he had no issue walking through a little snow, we could make it available to him any time. He said he would wait and pick them up the first of March. Jason didn't come down to remove our seats until March 23rd, 2011, which was just before the flooding season. We met him at the boat and explained again what we wanted and then requested again when he got one cushion completed to send us a picture so we can make sure we were on the same page. At that time we discussed getting the boat cushions back around April 15th, 2011. Jason said at the time that he had another job ahead of ours and would get to our job the following week. In early April we started to receive invoices for additional work. We were confused by this as we were very clear at the time of purchase at the boat show and very clear when he came and picked up the cushions. After multiple emails and almost 1 month later I think we all were on the same page for billing so at that time I sent another $550 to finalize the purchase expecting the cushions in a couple weeks. I received a call from Jason on April 20th stating he spent 3 hours trying to find the brackets needed for the split seat risers; I went on line and found them in five minutes, purchased them and had them shipped to him directly and sent an email stating this also requested that he let me know when they arrived, and he never did. At the time we spoke, I asked if this was the only item holding up our job,Jason replied with everything was on track except that seat. After 3 more weeks passed we contacted them and asked for an update. He apologized for them not being done but mentioned we were next in line and would have them done soon. We requested we needed them by May 20th for a family gathering. They stated they would try but worst-case I would have them by Memorial Day. Shortly before Memorial Day Jason called me telling me that he was going to bring our seats down and install them,and needed to know if our boat was in the slip or still on land. I was immediately surprised,and asked him if he had all the seats done? he replied with yes, I reminded him that we had asked for a picture after the first seat was done so we can make sure we are getting them exactly how we wanted them, Jason said he took notes and decided he didn't need to comply with our request, I asked for a picture, he sent one over of one of the seats and the pictured showed it was not done correctly. In a later conversation we described the problems we saw with the cushions and wanted them corrected. He stated we would have to pay him more money for time and materials. We said we would pay more for the one cushion because we expected that there might be some problems but would not pay anything for the other cushions he already made because no other cushions were to be made until we approved the picture of the first cushion. Jason stated it would take another month to get these done and we stated that was not acceptable and asked that he change the pleats in one and send us a picture. At the time he then said he could get a picture back to us in 4 days. We never did receive another picture of any seat completed, but received an email with pictures of the backs of 3 seats and a request asking us to draw on them exactly how we wanted the swoosh and pleats. We sent back the drawings the same day an hour and a half after receiving his email. Jason changed his time frame a few more times and said he would do one seat right away and send us a picture. That picture never came and during the last month he stopped answering his phone, he wouldn't reply to emails. Completely disappointed with the situation and needing some resolution we sent him one last email defining the situation and the terms to continue working together. We simply stated that we wanted to receive a picture in 2 days and get our cushions back in 1 week or we would come up and pick up the cushions and expect a full refund. We never received a reply. On July 5th, we went to his place of business and found he was not at the 1st street location, so we went to the 2nd avenue location and he wasn't there either, but showed up after we retrieved our seats and we requested a full refund. He said he had no excuses as to why the job wasn't done, He refused to refund our Money, saying he has time and materials into the job and if we left our seats with him he would eventually get them done, but couldn't say when, we again requested a full refund - he said no he wasn't going to give us any money back - period... and then called the local police to have us removed from his property. We spoke to the police when they arrived, explained the situation and the police stated that this is now a civil matter. Based on the picture received, the quality of work done, was not consistent or close to the quality in terms of the example we saw at the boat show or the photos on his website. As a result of this failed job, a Complete Breach of Contract, plus the fact that we've lost half of our boating season.
