Around August 15, 2012 I received a call from Scott Vaugh representing the Holiday Inn Vacation Club who were selling "time shares". The choice was between Myrtle Beach, SC or Smoky Mountain Resort in Pigeon Forge, TN. I chose Smoky Moutain Resort, which he than went into the sells pitch. I very foolishly fell for it ( and not trying to excuse myself in any manner)because I had experience buying a "time share" in the past with the Hilton Company. Well after months of receiving emails about my up coming vacation I found out in February that I could not keep my orginal date of arriving on Sunday, May 12, 2013, I called to change. After my discussion with Gloria I was charged a fee of $19.95 for changing the date. I was not happy about it but felt there was nothing I could do, so I accepted the dollar amount and it was charged to my credit card that they have on file. After receiving email after email about a month or so later I than received a "PLEASE CONFIRM" letter in the mail. I called the company on March 18th to confirm and at that time I spoke with Sabrina, who informed me after a series of questions about what catergory I fell into with referencet to income, that we are "not eligible" for the offer because our income is below $50,000.00. So I stated to her fine, than I can expect a refund of the $199.00 I paid to you and she told me that there is "no refund" and even though they declared us "ineligible" we would not get our money back. After a back and forth with her in which I stated that how are you just going to keep my money after the above declaration of not being eligible.
Finally I was allowed to speak with Valarie who is a supervisor. We had a discussion and she promised to listen to the recordings to see what statements I had made and the statements from the company employees. I was able to speak with Valarie again on March 25 at which time she played a recording from my orginal conversation with Scott Vaugh in which he asked me a series of questions one of which dealt with income. (Valarie did not play for me any subsequent calls dealing with any conversations about income.) No excuse but at that point I would say I was so excited about the prospect of going to Tenn I answered "yes, Yes' Yes! Since the initial conversation in August 2012 until March 18, 2013, income was never mentioned again. My complaint is how can you declare me ineligible for your program and keep my money at the same time.
