On July 11, 2012 we were contacted by Jonathan Frank a sales representative for Menus To Go. Mr. Frank sold us advertising for an ad in the Texas Roadhouse Menu. He told us we would be the only dental office in that menu and that there would only be ten other advertisers and it was exclusive. He also told us that they would be mailing the Texas Roadhouse Menu with the ad’s to over 10,000 homes in the Meridian, Idaho area. He also told us the menu would be placed in every to go order and in numerous local hotels. He stated that a $50 gift card would be given out monthly as part of the contest located in the front of the menu. He also told us that he asked the Texas Roadhouse employees if they had a favorite dentist and that is how he got Dr. Payne’s name and Wellpoint Dental.
None of what we were promised was ever completed.

One of the managing partners for Wellpoint Dental went to the Texas Roadhouse for dinner 6 weeks after the ad was supposed to be in the menu, and was advised they did not know Menus To Go and there was never ad’s placed in their menu. After numerous attempts to contact the sales representative we left a voice message with their marketing group in Chatsworth California that we wanted an explanation.

In November 2012 we received a letter from Menus To Go that they had placed our ad in the entertainment extra booklet located at the Meridian Idaho Winco Supermarket. They stated that it was in our contract that when they no longer had an account with an advertiser they could move our ad without our consent. We paid $1499.00 for the ad which was supposed to be in Texas Roadhouse which was never placed in their restaurants. Menus To Go also double charged our credit card for the final installment in December making the total amount they received from us $1864.00. We insist on receiving a full refund as we never received what was promised. We feel Menus To Go used sales tactics which were unethical and similar to a Bait and Switch. We have also retained an attorney in this matter and will advise the local AG’s office that Menus To Go is a scam.

We have again left messages for a return phone call in this matter and to date no one has returned our calls nor have they refunded our money. We feel we have no choice but to warn others of the scam. We do not want to have an ad in an entertainment booklet. This does not position our office properly nor does it accomplish any of our marketing goals. We have not received one new patient from the ad with Menus To Go. We will advise the State Dental Association as well as other States we have friends and partners about this scam. It would be in Menus To Go’s interest to refund our $1864.00.

Sincerely,

Warren Willis DMD

Quinn Brown DMD
