Run away! These people are a NIGHTMARE...

I've had a really bad experience with Remax Partners (R0040265) in Corona, CA. We were in the process of buying a house one of their agents, Monika Smith, was representing the property. It's quite a long story of the things that have happened so I won't detail it here but the sellers were trying to sell the shutters and fixtures to us to make a profit when they were already attached to the house and it was a short sale.

Then the sellers tried to back out of the sale after we agreed to move forward and did the inspections and appraisal to the property. My Agent and my wife went to their office to talk to the broker, Jill Wasson, to try to get the situation rectified.

Jill was extremely rude to my wife and agent which I did not appreciate at all. The seller's with the support of Monika and Jill tried every way to close escrow even though we agreed on everything and we were ready to sign final loan docs 2 weeks. We hired a lawyer to show the sellers that they have no grounds but they didn't respond to any of our letters.

We have incurred over $4,000 in costs for this home which has turned out to be a nightmare. I want to let you know of the situation and that I won't do any business with Re/MAX because of this situation and the unethical things Monika and Jill allow to happen.

We were advised by another lawyer that going further was incur more costs and may not get our costs back so we decided to cut our loses and start moving on with our lives.

It's a shame since they obviously were in the wrong on this issue. Also, they are very sneaky which leads me to believe they've gotten away with this before.

After that we decided that it wasn't worth going after the house and just want to get our deposit back. Escrow, which is in the same building -- Also illegal -- is holding our $10,000 deposit hostage because we crossed out the Seller Agent and Broker free from any claims of wrong doing.

We have reported this to the DRE who supported our decision to cross out the Seller Agent and Broker from the Escrow cancellation.

I have also contacted RE/MAX HQ with this as well to hopefully help us with this unethical behavior. and also give them all the evidence we have against them.

DON'T DO BUSINESS WITH MONIKA SMITH OR JILL WASSON.

  • The comment of the individual mandates a response. First of all this person is not our client.

    In November 2012, this escrow was cancelled by the seller due to buyer non-performance. A contingency removal was sent to Brian P.'s wife's agent, Penelope Salazar, (Brian P.'s wife Suzanne was the buyer not Brian P.) for removal of all buyer contingencies. The buyers agent returned contingency removal without removal of all contingencies. As per the residential purchase agreement, within the specified time, the buyer is to deliver to seller a removal of the applicable contingency (which the buyer did not do). The seller then exercised their right to cancel the agreement/transaction/­escrow and return the buyers earnest money deposit of $10,000.

    Brian P.'s wife refused to sign the cancellation which caused the buyers $10,000 deposit to remain in our escrow. The buyer, with a demand to close escrow and letter from Habashy Law Firm stating the same, attempted to force the seller and their agent's hand to sale the property to the buyer. After legal representation from the sellers side and the lisitng agent, Monika Smith's side, Habashy Law Firm advised Suzanne P. that it would be in their best interest to cancel this escrow and obtain their escrow deposit back.

    Brian P.'s wife, through their attorneys, wanted the sellers to pay $7,000.00 for their attorney fees in addition to the return of their $10,000.00. The sellers would not agree to their request. The Habashy Law Firm sent a couple emails and letters to our agent at Re/Max Partners and to the sellers. All of which were responded to accordingly and in a timely manner.

    Being that the property was a short sale, the buyer was not entitled to the return of any costs that they incurred which were associated with the failed transaction. Monika Smith did nothing unethical, nor did I.

  • When meeting with Brian P.'s wife, Suzanne and her agent Penelope Salazar (Brian P. was not present). I was not extremely rude. Having our own escrow in the same building is not illegal.

    The buyer finally decided to cancel and she received her $10,000 back from our escrow in full.

    Monika Smith is one of Re/Max Partners top agents. Re/Max Partners has proudly served Corona and the surrounding communities for over 22 years. We have a host of outstanding agents who practice real estate here.

    Our reputation for honestly, integrity and genuine care is well documented. There are numerous online testimonials for our agent, Monika Smith, which fully support that. It is unfortunate that Brian P. seems to want to discredit us because we would not yield to his unreasonable and unwarranted request. I think that if Brian P. were in our shoes his response would be the same as ours.
