I recently signed up for BidRack to try and win the macbook pro for my brother. I bought 2 $27 packs and 2 $60 packs. While I was bidding on my items, the site went down for maintenance, and when I came back the macbook auction was gone as well as the 100 bid pack auction. I only signed up on the site to win a macbook pro that night and nothing else, but now there are no auctions for the macbook pros!

I emailed asking for my money back but have not heard yet. I also called the 1800 number and the lady said she could only give me my bids back and not the refund, I would have to email for the refund.. so that is what I did.

Anyway,
I understand there is a no refund policy (although there is no checkbox in the registration process for me to confirm I agree with the terms of use and refund policy so I would argue the legality and enforceability of your policies if the user has not agreed and has not been made aware of the policies throughout the registration process - I am a media designer and have had classes in Internet law - the policies will definitely not hold up in court.)

I feel very discouraged and taken advantage of, it seems as though right when all my bids are almost gone and I am about to win - the site shuts down. That seems very shady to me.

I still have the 60 bids which is the $27 pack, but the other bids were wasted. I would like all bids from removed from my account and refund the total amount of the bids purchased - $174 - since I will not be able to utilize the site and it was no error on my part - only on the website's part of why I did not win and my bids were wasted.
