I was contacted by Alliance Private Equity LLP in Atlanta that shares I owned were subject to a default notice, and were worth $146,250. Was I interested in them? I immediately thought that this was a scam! but said yes as long as I would not be required to pay any money "upfront". A few days later I was told that the shares were "restricted" and that a payment of $6300 was needed to de-restrict them. At first I said definitely not! but by this time had got quite friendly with an employee of A.P.E. who was English, and seemed very honest. He said he that this was genuine and on the strength of this I agreed to pay the $6300 but with the condition that there would be NO MORE costs involved. This was specifically put to Mr Reese who never gave any indication that there might be!
I was told that the money would be tranferred by a certain date - the date came and went and I contacted Mr Reese to find out what was going on and when was I to receive the money. His response is why I am complaining strongly, as his duty of care had proved to be non existent! He told me that the shares were subject to "warrants" and that to release them needed a payment of $45,000!
He failed to act in a proffessional manner on the following counts.
1)He hadnt contacted me about this and left it to me to ring him.
2)He had failed to give me any warning that this might happen, despite me specifically asking him if there was any likelihood of extra costs. If he had mentioned it I would never have risked the $6300 I paid him initially.
3)I suggest that he must have known about these"warrants" when the investigation that they were restricted was made, but he deliberately hid the fact.
I am 70 years old and live off my state pension of £130. I cannot afford to lose so much money and borrowed to pay the $6300, and this has left be bereft, having to leave what was my modest home to one that is almost a slum! and a debt of $6300 I have to repay!
Mr.Reese in his position of responsibilty has a duty of care,in which he failed miserably.
