My wife used to work as Head of Admin. for an investment company (she is currently a stay at home mom with our 2 and 1/2yr old boy and our 12 day old girl). She had a Capital One company credit card which she used to purchase office supplies and such. She quit working for that company near the end of 2010. The company later went out of business, with a debt of roughly $1200-$1300 left on the Capital One company credit card.
We received in the mail a letter from Machol & Johannes stating that a judgement request has been made to the Court in regards to the Capital One account (now to the amount of $2438.30 plus interest and Court costs). This was the first and only document we have ever received regarding the matter. The letter was dated March 11, 2013, but as we have moved several times over the last few years for my work, we never received the letter until the end of March. We have never been served with anything or even received a phone call in regards to it.
And that brings us to to April 12, 2013, when we tried to make a purchase from that account, only to find out that our card wouldn't work - they pulled out $495.53 and then a $75 litigation fee - totaling the entire balance of that account. They tried to pull the same amount again, which would put our account into the negative, however our bank rejected that charge, leaving the balance at $0. I don't even think they have legal grounds to go after a past employee for a business credit card, let alone the way they did it. Best of all they did it on a Friday afternoon. Now we're frantically scrambling to get money and use another account to pay our upcoming bills and route my paychecks into so that they can't pull more money out at their convenience. There has to be a way to stop this!
