they give ad in ebay says that they sell iphone4 for $629.for this we need to pay through their st.george bank in sydney...i paid money throgh this bank and the next day ebay send me a mail shows that dont pay to this seller..i just contact with my bank and they said that they cant do any thing with this...so i contact with Incredible Gems and Electronic Overstock Solutions via ebay messages...they replied that they got the money and will be send my product ASAP.but nothing happens...after that they didnt answer any of my question...so now i am planning to do something with legally....

    This is eaxctly what happened to me. I have been trying to contact the seller. I have spoken to ebay also and they say that the seller is reliable and we are likely to receive the phones. Have you been told anything different? If so what legal action are you taking?

  • i just spoke to my bank and they said that they can't do any thing with this..they suggest me to file a complaint in federal police against this account holder ....i think nearly 70 people were scammed with this seller...that means 70*629= $ 44,030.............its not a small amount

  • Martin I spoke to my bank last week after e-bay sent the notification that the item was removed. They can send a request to the bank I lodged the money too though it doesn't guarantee I'll get it back :( It cost $50. Is there anything else we can do? That's a huge amount of money!   • hi gees83 ....i did this payment through my commonwealth bank..when i spoke to them they said that we will not get this money back from st.george bank..because its an online scam. so they strongly advice to give one complaint in police...they are the right people to help us..they can contact with the cyber cell and get our money back....

  • Oh so have you went to the police yet? What have they said? The thing is if you long onto ebay and onto incredible gems there is a message saying "All orders will be processed. We will return 9/12/2011. I don't know what's going on. I can't get any answers from anyone :( Thanks, Stacy.

  • Hi guys, I'm in exactly the same position, except Ebay didn't reassure me that they thought it'd be delivered. Ebay suggested that I report this on a fraud website, and I have done that, although the site I seemed to have to use was in America as Incredible Gems is located in Florida. However as Electronic Overstock is in Australia maybe I should try the Aussie fraud people... Same story as above, Incredible Gems reassured me that everything would be fine and my phone delivered within 5 business days, and now I get no reply to any emails I send.

  • Have you been on ebay since Trackers? I have been in contact with ebay too and they have tried to contact the seller via e-mail two days ago but again I have heard nothing. However like I said on my previous message I have noticed when you log into ebay and go into incrediblegems store it says All orders will be processed. We will return 9/12/2011."   • Yes, I saw same message, and I think surely ebay would have just completely closed them down if they thought they had defrauded so many people out of so much money, but who knows? I'm doing as much research as I can but don't seem to be getting too far. Ebay gave me a link to give to Police if someone makes a complaint http://pages.ebay.com.au/securitycentre/law-enforcement.html as they said they are able to provide them with some assistance. They also recommended I file an "item not received" complaint - you do this by going into My Account then the Resolution Centre then Item Not Received and follow the prompts. I guess the more people who report them the better chance we have of a resolution...

  • ok, so i've done some more research and found the ACN of the company i paid my money into. they are called EPW Electronics Pty Ltd and their ACN is 152 885 213 registered in Sydney on 26/8/11. i don't know if that helps anyone. i've also gone on to file a formal complaint with the Aussie fraud people. i'd encourage everyone who's in the same situation to do that, doesn't take too long.

  • Trackers, I went into my account on ebay and into resolution center. When I tried to make the complaint this is the message I got back;

    You can open this case on 16-Sep-2011.
    Cases can be opened 10 days after the listing ends. To resolve the problem now, contact the seller.

  • Trackers, they are telling me that website for the fraud police is invalid? Is that definately the link you used. I don't know either why they are reassuring people. My main concern is why is ebay still not letting me file a case to the item ends if the item has been removed and we have been defrauded??? I am confused and getting nowhere fast. Thanks, Stacy

  • I had the same message too Stacy, but it was okay when I tried this morning. Maybe your listing ended at a different time to mine. Try again later or tomorrow because Ebay's time setting may be different to ours, and I guess they will make the 10 days go right to the minute it ended... Tracey

  • My question is if the item has been removed then why is there still an end time according to ebay??? This shouldn't be especially because there are so many people in this situation and just want their money back? Can you please resend the link for the fraud guys?     I have submitted a complaint to the QLD Fraud dept. I have also tried submitting a complaint to the ebay resolution centre and it won't let me as it says I have to wait until 10days after the item ends which means I can't do it until 26th September. Have you had any more feedback from ebay or the QLD fraud dept? I have been back on ebay and the incrediblegems store is back up and running??? What is going on?? Thanks, Stacy

  • Hi Stacy, I spent most of yesterday trying to get answers and I did get some finally. However not the answers we'd like. I've been on the ebay forums page and put my issues on there. Some people were really helpful in suggesting what I should do. It's a scam for sure, and ebay aren't going to be much help I don't think (or that's what I was told). The person from Incredible Gems responded to my complaint by saying that their account had been hacked so it was not their responsibility. I ended up escalating the claim to ebay fraud section because I don't know who's telling the truth anymore, however it certainly looks like ebay have figured out that their account was hijacked. They have made no other offers of help and I don't think they will either. The best suggestion I had was to file a claim with the small claims tribunal as they are the only ones likely to be able to get our money back. I'm gonna get onto that in the next couple of days. I reckon that's about the best we can do. If you haven't kept all of the bank details regarding your deposit let me know and I can forward them to you, although one ebayer has apparently found two different bank details for him - one at CBA & other at St George.

  • Same thing happened to me, i called the seller last Tuesday and he said because of they changed the computer so the item is not searchable in eBay, and he let me to wait for another 4 days if not, he'll give me the AU contact no. Of course i didn't receive the iPhone, I've been trying to call him everyday he didn't respond to me. I have went through my bank to submit the dispute but Commonwealth said they can't guarantee the money back. I think we definitely need to report this to the police and fair trading locally, let's get our money back!

  • I totally agree Ivy. Make sure and report an item not received to ebay through the resolution centre. I also filed a complaint to the QLD Fraud dept as advised by trackers above. We need to do everything we can to get our money back! It's an absolute joke! Apparently incredible gems account was hacked.. Trackers was advised of this also!   • Hi guys, same thing has happend to me, just got an email from incredible gems, see below:

    Hello,

    Id like to apologize for our delay in responding to our customers. We are working with eBay to best resolve and provide the most information for customers - there was a security breach on our account. Our company, Incredible Gems does not sell electronics of any sort. Our eBay account was hacked and the iPhone 4 was listed twice, on both occasions eBay's system detected noticed an unauthorized access, and removed the listing. Unfortunately, it was after many phones have sold. The hacker continued to communicate with buyers and defrauded many people pretending to be Incredible Gems. I apologize and hope you are able to recover your funds. We are not familiar with the laws in Australia or how you can recover your funds, we do not have the money to issue a refund as it was the hackers bank account nor any iPhones. At this point there is nothing further we can do. The company Overstock Solutions is a known scam artist and can be found on google. You might start there. Best.


    Let me know what you guys do to resolve this, is there anything we can do together to re-claim the funds?
    I am going to my local police station and submitting all information.
    Fingers crossed I'll get some sort of resolution.

  • I can't believe there are people like this out there. Hopefully they have brought such bad karma upon themselves that they'll get what they deserve! I haven't heard back from either o/s fraud squad or qld fraud squad, but I wouldn't be surprised if we never heard anything. I think the only way we're going to see any money is if we are proactive in getting in back ourselves by taking this guy or people to the Small Claims Tribunal. I haven't had a chance to look too far into how to do this because my computer at home is crap, but I'll try to do so today if I get a chance. I know there is a small filing fee involved (less than $50) which would be well worth it. If anyone has gone this far, let us know how you got on. Cheers, Tracey.

  • Hi guys, I am still in disbelief that this has happened. I was able to do a trace and recovery with my Commonwealth Bank for a fee of $50. They have sent a request to the St Georges bank hoping for the return of the money but it is not definate as I am sure the scammers don't let the money lay too long. I will also be taking this to the Small Claims Tribunal. I think if we all keep updating eachother and providing advice we each receive then hopefully we cn recover our funds!! However I have a feeling it may take some time!! Ebay have said they contacted the seller - clearly it's not the scammers as the email address is incredible gems!! It costs $76 but is included in the amount you claim so all being well that will be obtained also. It's form 4 and is very simple and quick to fill out.   • Cremorne NSW 2090, Australia was the only address I had for them. Regardles of the address Tracey, They're bound to be able to work with the authorities etc and help get our money back. There has to be ways of tracing where they were responding from etc. There arer so many of us in the same situation that there has to be away of getting them. Have you heard anything more from ebay etc? I was told after 10days of my complaint in the resolution centre they will escalate it further.

  • The e-mail I received from them they assured me the claim will be closed in my favour. Can't remember the exact wording but if the seller doesn't respond within 10days ebay will take it to the next level. I just have to sit tight and wait :( I have did the trace and recover through my bank, I have sent a complaint to the QLD Fraud Dept and file a Small Claims case through the Perth Magistrates Small Claims. I am hoping for some answers soon. This sort of scams should not be happening and these people need to be caught!! I would urge everyone to file as many claims/complaints as possible to help speed up the process and urgency of the matter. Is there anywhere else that people should be notified? Thanks, Stacy

  • Hey same has happened to me too.. ive reported it to Waverly Police but they did SFA! I've opened an Ebay dispute on 15th Sept but no feedback there yet. Has anyone gotten any sort of positive feedback from the fraud police? Is anyone going using a legal rep that we can all use? Might make for a stronger case if a few of us use the same one!?!

    The fraudulent activity on our ebay account incrediblegems and statements made here are inaccurate, it is documented in eBay's system that a third party accessed our eBay account. The third party gained acces to our e-mail accounts and responded on our behalf assuring you would receive your phones, never has our company sold items specifically in Australia, nor accepted payments to an Australian Back Account, sold electronics. Our company sells Jewelry and Aftermarket parts. Included in this scam is our company, monies that were sent via wire transfer to this St. George account are being paid for on our behalf. Overstock solutions has defrauded people time and time again, aside from this transaction, you will see 100% feedback for incredible gems and not one association if you search for our company.

    There is no doubt that your company has been trading for quite a few years and with 100% positive feedback, after all this is the reason we all entrusted the positive feedback and purchased iphones so confidently based on track record and positive feedback!!
    In saying all this we were all ripped off!!! A lot of hard earned money and we all have ourselves to blame for paying via direct bank transfer instaed of paypal.
    I understand your claim that your account was hacked, and if this is what your claiming we can’t categorically deny this as it happens every day to a lot of people and you would be silly to damage your own company which took you years to build up for a few thousand dollars.
    Can you please tell us what you know so far about the actual perpetrator, has he been identified, is there any further information you can share with us to help us recover our funds? Are we ever going to get our money back?
    We would appreciate any further info to help our cause.

    EPW, Overstock Solutions seems undoubtedly the actual perpetrator - if Jay Jun Chung is not alias, I see no reason why you cannot retrieve your money. We received an eBay message, of a person who purchased an iPhone with the exact listing that was listed under our companies, under a different eBay user ID and same bank account, what we also know is that we had seen an ACN that was registered 5/29/11. Jay Jun Chung had to have gone to the St George bank to receive the funds, as well as register the ACN. Here in the states, there are cameras in banks, and you must show ID to register a business. eBay does not have information or supplied us with any and we are losing thousands, our holiday season will most likely be lost because of it, we want to see this man put to justice. You will notice we have had to pull over 5500 listings. I hope you all realize that I (the real Michael) am on the same side and would like this scammer put in prison, damages paid, rightfully so. I am not familiar at all with any Australia law, but will help in anyway I can.

But I haven't heard anything. Would really appreciate it is anyone could let us know if you hear anything positive come from this.

  • I've done all I think I can do, but have heard nothing positive back from anyone. I guess this would be considered a fairly small fraud in the grand scheme of things, and so not top of anyone's priority list except for those of us who have been ripped off! I'm especially disappointed in Ebay for not even bothering to try to help us out - sure we all made a mistake by directly depositing money but after all this is the way it was always done before Paypal came along - I thought there should at least be some kind of insurance by Ebay...

  • Hi guys, I am in the same boat really. I haven't had any real feedback back from anyone. I have lodged an application with the small claims court though havent heard anything back as of yet! Also haven't heard anything from the NSW Fraud dept or from the Commonweath Bank where I did a trace and recovery. These things do take time and I would encourage you all to stay positive and keep pushing as hopefully as said previously they know the identity of Jay Jun Chug as he would have had to go in and lift the money from the St George Bank. Keep the pressure on all the depts you've been in contact with and push ebay as far as we can. Thanks, Stacy

    eBay is a business and while I share your frustration, a business is there to make money, and will not willingly spend extra time pursuing scammers, as mentioned, to them 50,000 is made in minutes if not seconds. While it will take time, in types of fraud, identity theft, scams, a class action lawsuit and positive outlook are your allies. Best of luck.
